Proposal to draw up a record of administrative violations in the field of environmental protection
According to Nguoi Dua Tin 's source, on November 6, the interdisciplinary inspection team of Quang Ninh province coordinated with Cam Pha City People's Committee to inspect the urban area project at area 10B, Quang Hanh ward, Cam Pha city of Do Gia Capital Company Limited (Urban area project 10B).
In particular, the inspection reflected that the construction of the 10B urban area project encroached on Ha Long Bay, affecting the water quality of the bay, and the dumping of soil directly into the waters of Ha Long Bay without environmental protection solutions, risked causing environmental pollution.
At the time of inspection, the project owner was constructing a public service road that coincided with routes 2, 3, 4, 5, 7... according to the approved planning in Decision No. 5099/QD-UBND dated September 16, 2021 of the People's Committee of Cam Pha City, Quang Ninh Province (the road is located within the project boundary, about 3 m from the project boundary).

The total length of construction is about 1,000 m, the construction material of the service road is rough stone, the road surface is covered with crushed stone, the outer edge of the service road in some sections is reinforced with boulders, the remaining sections the project owner directly dumped soil without any measures to limit mud and rock from being washed into the marine environment.
Along the service road adjacent to Lo Phong stream, there is a phenomenon of soil and rock washing away, causing localized turbidity (about 5 m range) of the coastal seawater area. At the end of the service road, the area adjacent to the rocky mountain, the phenomenon of dumping soil causing mud to rise has not been treated yet.
The project investor used 10 containers with a total length of about 200 m to surround a part of the service road to create a construction site for the embankment along Lo Phong stream. At the same time, they are laying a layer of geotextile fabric outside the service road at locations where containers have not been surrounded.
At the time of inspection, the investor had not yet presented the construction site and construction method documents, and had not yet reported to the People's Committee of Cam Pha City for consideration and approval according to the opinion of the Department of Construction of Quang Ninh stated on Page 2 of Construction Permit No. 82/GPXD-SXD dated July 24, 2023. The project owner's construction diary was incomplete for the construction of the official road.
Along with the request for the investor of the 10B Urban Area Project to immediately stop construction activities on the public service road leading to the project, the inspection team requested the competent authority to draw up a record of administrative violations for 2 violations in the field of environmental protection.
Proposal to inspect and handle from September 2023
According to information from the Ha Long Bay Management Board, on September 19, 2023, through environmental monitoring work along the Ha Long Bay coast, the unit recorded that the 10B Urban Area Project was dumping soil directly, without a dike, into the sea area belonging to the buffer zone of the Ha Long Bay World Natural Heritage and protection zone 2 of the Ha Long Bay Special National Monument.
According to the Ha Long Bay Management Board, dumping soil directly into the waters of Ha Long Bay without environmental protection solutions will pollute the water environment, affect the ecosystem of Ha Long Bay, violate regulations on environmental protection, heritage protection according to the Law on Environmental Protection, the Law on Cultural Heritage, and the environmental impact assessment report of the project approved by the People's Committee of Quang Ninh province.
The Ha Long Bay Management Board has sent a report to the People's Committee of Quang Ninh province and requested the Department of Natural Resources and Environment, the Department of Culture and Sports of the province, and the People's Committee of Cam Pha City to inspect and request construction units to comply with the provisions of the law on environmental protection, heritage protection, and at the same time have solutions to prevent substances that pollute the environment and ecology of Ha Long Bay.

On September 27, 2023, the Department of Natural Resources and Environment of Quang Ninh province coordinated with the Department of Agriculture and Rural Development of the province, the Ha Long Bay Management Board and the People's Committee of Cam Pha City to conduct an inspection and verification. Based on the inspection results, on October 4, 2023, the Department of Natural Resources and Environment of Quang Ninh province sent a document to Do Gia Capital Company Limited - Investor of the urban area project in area 10B.
In particular, the investor is required to implement technical solutions to reinforce the service road, ensuring that no soil or rock is washed away into the coastal seawater of the project. Dredge areas with mud rising due to construction activities of the service road, and have solutions to manage the volume of dredged mud in accordance with current legal regulations. Organize the construction of the embankment surrounding the project before leveling the ground according to the approved environmental impact assessment report.
In response to the request of the Department of Natural Resources and Environment of Quang Ninh province as well as the authorities of Cam Pha city, relevant agencies and functional units, on October 10, 2023, Do Gia Capital Company Limited reported on the correction and handling of the requested contents.
However, the investor has not yet thoroughly resolved and handled the situation, leading to the fact that on November 6, 2023, the Interdisciplinary Inspection Team of Quang Ninh province requested to stop the construction of the official road to the project, requesting the competent authority to draw up a record of administrative violations for 2 violations in the field of environmental protection .
The 10B urban area project was approved by the People's Committee of Quang Ninh province at the end of October 2021 with a total area of 31.8 hectares, including the following items: 451 villas and townhouses, rough construction and exterior finishing of 52 villas. The project was implemented in the form of land use rights auction, Do Gia Capital Company Limited won the auction with a price of 1,192 billion VND.
Of the 31.8 ha area of the project, 3.88 ha is located in the buffer zone, protection zone 2 of the Ha Long Bay World Natural Heritage. The project has been licensed by the Department of Construction of Quang Ninh province and construction has been implemented since July 2023 and is expected to be completed and put into use in the third quarter of 2026.
