On the morning of October 10, at the national online conference to review the work of ensuring traffic order and safety in the first 9 months of the year, Mr. Nguyen Xuan Cuong - Director of the Vietnam Road Administration pointed out a number of "loopholes" in the regulations on managing transport business vehicles.

Mr. Cuong said that the Department has deployed the installation of journey monitoring devices (GSHT) and cameras to monitor the history of transport business vehicles. Through the devices and cameras to monitor the history of transport business vehicles, in the first 9 months of the year, the Department of Transport of localities has handled violations by revoking badges and signs for 469,739 vehicles, of which the badges of more than 25,000 vehicles were revoked.

Mr. Cuong informed that according to the previous Decree 86, the badge of a speeding vehicle will be revoked for 1-2 months. Accordingly, a vehicle whose badge is revoked will be reissued a new badge 2 months later. However, when amending Decree 10/2020/ND-CP, this content did not stipulate this.

Because there is no regulation on the time to re-issue a badge or sign after it is revoked, a business that has its badge or sign revoked today can re-apply tomorrow.

“The regulations are backward compared to before. This is one of the reasons leading to ineffective management. The Department has also proposed amendments,” said Mr. Cuong.

Immediately fix shortcomings, increase sanctions

Concluding the conference, Minister of Transport Nguyen Van Thang assessed that in the first 9 months of the year, although traffic accidents have been controlled, there are still some shortcomings and limitations.

Accordingly, the number of casualties due to accidents remains high, with some particularly serious traffic accidents resulting in many deaths and injuries. Traffic congestion in major cities tends to become more complicated.

“Regarding the cause, I emphasize that in addition to the direct actions of the driver causing the traffic accident, there is also indirect responsibility of state management at related stages,” said Minister Nguyen Van Thang.

According to the Minister, the recent shortcomings are largely related to the institution, so the agencies of the Ministry of Transport, according to their functions and duties, must pay special attention to perfecting legal regulations. For the Ministry of Transport, the first priority is the draft Law on Roads and coordinate with the Ministry of Public Security to perfect the draft Law on Road Traffic Safety and Order.

In particular, the Ministry also assigned functional units to quickly amend regulations to manage the operation of commercial transport vehicles more effectively.

“The recent traffic accident in Dong Nai showed many shortcomings, the passenger vans of the violating company (Thanh Buoi bus company) had their badges revoked a total of 246 times. So is the revocation of those badges really effective? There must be stronger and more drastic sanctions from revoking the license to terminating and permanently banning business in this field,” Minister Nguyen Van Thang emphasized.

The Minister also assigned the Roads Department to review the regulations to prevent the new regulations from “falling behind the old regulations”. The Minister proposed immediate amendments in the direction of increasing strict penalties for bus companies that repeatedly violate the rules, and for their drivers who repeatedly and seriously violate the rules.

“The units coordinate with the Ministry of Public Security, provinces and cities nationwide to promote the application of IT in managing and handling violations that cause traffic accidents. Strive with many other solutions to create a traffic culture that cannot be violated, does not dare to violate and does not want to violate,” the Minister concluded.
