After the serious traffic accident caused by the Thanh Buoi bus driver, Minister of Transport Nguyen Van Thang said that in addition to the direct actions of the driver causing the traffic accident, there is also indirect responsibility of state management at related stages.

According to the Minister, recent shortcomings are largely related to institutions.

“The recent traffic accident in Dong Nai showed many shortcomings, many passenger cars of the violating company (Thanh Buoi bus company) had their badges revoked a total of 246 times. So is the revocation of those badges really effective?”, Minister Nguyen Van Thang questioned.

Also related to this issue, speaking with VietNamNet reporters on the sidelines of the national online conference to review the work of ensuring traffic order and safety in the first 9 months of the year, Mr. Khuat Viet Hung, Vice Chairman of the National Traffic Safety Committee, pointed out the fact that since the beginning of the year, there are some bus companies whose badges and signs have been revoked hundreds of times. However, the strange thing here is that the business is still operating normally.

"Thus, it is clear that the current regulations have a "loophole" regarding the time limit for revoking badges and signs, leading to businesses not being afraid," said Mr. Khuat Viet Hung.

Mr. Nguyen Xuan Cuong, Director of the Road Administration, said that in fact, Decree 86/2014 regulating business and conditions for automobile transportation business previously stipulated that vehicles whose badges and plates were revoked would be reissued with new badges two months later. However, when Decree 10/2020 was amended, this content was removed.

Because there is no regulation on the time limit for re-issuing a badge or sign after it has been revoked, businesses that have their badges or signs revoked today can re-apply tomorrow. “The regulation is backward compared to before...”, Mr. Cuong acknowledged.

On the morning of November 2, speaking with VietNamNet reporters, the director of a large bus station in Hanoi said that the fact that badges can be revoked today and reissued tomorrow is a reality that needs to be adjusted soon.

"Usually, vehicles that violate the law only need to complete the fine payment form and the traffic department can reissue the badge.

Processing time depends on each locality. But usually within 2 days, the Transport Management Departments of the Departments of Transport will reissue the certificate after the business and driver complete the necessary procedures. It's very simple," he informed.

If the car is left in the parking lot for a month, the business will be responsible.

To patch this “loophole”, the Ministry of Transport is currently seeking opinions from ministries and branches on a draft Decree amending and supplementing a number of articles of Decree 10/2020 regulating business and conditions for automobile transportation business. In particular, the ministry proposes to tighten the issuance and revocation of badges and signs for vehicles engaged in transportation business.

According to the Ministry of Transport, Decree 10/2020 stipulates handling violations by revoking transport business licenses, suspending route operations, and revoking badges and signs. However, there are no regulations on the revocation period or how long after revocation it can be reissued.

“This reduces the effectiveness of management and does not ensure deterrence in the handling of violations. In addition, some revoked units intentionally do not submit to the issuing authority in accordance with the revocation decision, but there are no sanctions to force the violating units to comply with the revocation decision…”, said the Ministry of Transport.

Therefore, the Ministry of Transport proposes to amend and supplement Clause 11, Article 22, in the direction of adding regulations on the time to revoke badges and signs.

Specifically, within 15 days from the date of signing the penalty, the transport business unit must return the badge and sign. The Department of Transport will not reissue the badge and sign within 30-60 days (depending on the case of revocation) from the date the transport business unit returns the badge and sign.

In cases where the transport business unit fails to submit within the above deadline, the Department of Transport will continue to post the decision to revoke the transport business license and badges and signs on the unit's electronic information page.

Within 15 days from the date of posting, if the transport business unit still does not submit, the Department of Transport will update the inspection management program to warn the vehicle related to the violation to have its badge and sign revoked.

Fully supporting this amendment, Mr. Khuat Viet Hung analyzed: “If we stipulate a 30-day withdrawal period for badges and signs, then business vehicles will have to stay parked for a month, immediately affecting the economic interests of vehicle owners. This is also a deterrent and warning to business owners, forcing businesses to be more responsible for drivers and vehicles. I think this regulation needs to be amended soon.”
