How is the election of village and residential area chiefs in Hai Duong carried out?

Accordingly, in order to unify the implementation of the election of village heads and residential area heads for the 2024-2027 term in the province, the People's Committee of Hai Duong province requested the People's Committees of districts, towns and cities to guide the People's Committees at the commune level to implement the election and dismissal of village heads and residential area heads according to the procedures and regulations in Decree No. 59/2023/ND-CP dated August 14, 2023 of the Government detailing a number of articles of the Law on Grassroots Democracy Implementation in 2022 (this Decree takes effect from August 15, 2023).

According to the provincial Department of Home Affairs, the new point of Decree 59/2023 is that the election of village and residential area chiefs will be organized in the form of conferences or meetings of the residential community, with the participation of voters or household representatives. Voting to elect village and residential area chiefs will be by show of hands or secret ballot. The option is selected when more than 50% of household representatives attending the meeting raise their hands to vote in agreement. Previously, the election of village and residential area chiefs was conducted continuously over 1 day, with voters coming to vote scattered at polling stations during the day.

According to the provincial Department of Home Affairs, up to now, the election of village heads and residential area heads in the province has been carried out according to the procedures and regulations in the decisions of the Provincial People's Committee, including: Decision No. 16/2013/QD-UBND dated August 7, 2013 on promulgating the regulations on organization and operation of villages and residential areas; Decision No. 18/2019/QD-UBND dated May 30, 2019 amending and supplementing a number of articles of the regulations on organization and operation of villages and residential areas issued together with Decision No. 16/2013/QD-UBND. The above decisions are still in effect.

After the Law on Grassroots Democracy Implementation in 2022 took effect, the Government issued Decree No. 59/2023/ND-CP dated August 14, 2023 detailing a number of articles of the law, including provisions on the process of electing village heads and residential area heads. Meanwhile, the Ministry of Home Affairs is still drafting a circular guiding the organization and operation of villages and residential areas (including regulations and guidance on the process of electing village heads and residential area heads); the Provincial People's Committee has not yet issued Decisions to replace Decision No. 16/2013/QD-UBND and Decision No. 18/2019/QD-UBND. Therefore, the guidance of the Provincial People's Committee is the basis for localities to unify and implement.

By October 4, Hai Duong had Chi Linh City, which had completed the election of village and residential area chiefs for the 2024-2027 term. Cam Giang, Binh Giang, Kim Thanh districts and Hai Duong City had scheduled the election date for village and residential area chiefs. Of which, Cam Giang and Binh Giang districts held the election simultaneously on November 10. Kim Thanh district held the election on November 24. Hai Duong City held the election on December 8, Tu Minh ward held the election in October 2024 and Tien Tien commune held the election in February 2025. The remaining localities are developing plans and guidelines for the election of village and residential area chiefs.
