Why do many former officials who committed violations immediately pay compensation?

Recently, after the Chairman of Lam Dong Provincial People's Committee Tran Van Hiep was arrested, Mr. Hiep's family proactively paid 4.2 billion VND to remedy the consequences for the defendant.

Specifically, on January 3, the Department of Investigation Police on Corruption, Economic Crimes, and Smuggling (C03) of the Ministry of Public Security received 4.2 billion VND from the family of Mr. Tran Van Hiep, Chairman of the People's Committee of Lam Dong province, to remedy the consequences for Mr. Hiep.

Chairman of Lam Dong Provincial People's Committee Tran Van Hiep was arrested for accepting bribes. This is a new development in the process of expanding the investigation into the case of bribery, bribery acceptance and abuse of position and power while performing official duties that occurred in Lam Dong province and some related localities. This case is under the monitoring of the Central Steering Committee on preventing and combating corruption and negativity.

Previously, on December 29, the Thanh Hoa Provincial Police Department issued a decision to prosecute and apply preventive measures to prohibit Mr. Trinh Van Chien, former Secretary of the Thanh Hoa Provincial Party Committee, from leaving his place of residence to investigate violations related to the Hac Thanh Tower case.

After being arrested, Mr. Trinh Van Chien (former Secretary of Thanh Hoa Provincial Party Committee) proactively deposited about 22.5 billion VND into the temporary account of the police agency to remedy the consequences.

Previously, Mr. Nguyen Dinh Xung (former Chairman of Thanh Hoa Provincial People's Committee) also deposited about 22.5 billion VND into the temporary account of the police agency, to serve the investigation and remedy the consequences of violations at the Hac Thanh Tower project when the defendant was still in office.

In addition, Ms. Dinh Cam Van (former Director of Thanh Hoa Department of Finance) also paid 10 billion VND to remedy the consequences of her involvement in the Hac Thanh Tower case.

The above defendants were prosecuted for investigation of the crime of "violating regulations on management and use of state assets, causing loss and waste" under Article 219 of the Penal Code.

Submit remedial action at trial stage

During the trial of corruption cases, at the first instance and appeal trials, some defendants who are former officials and public servants also proactively or mobilized their families to return part or all of the bribe money, or money related to the case, to remedy the consequences.

For example, in the “rescue flight” case, the investigation results determined that the former leader of BlueSky Company gave former Deputy Director of Hanoi City Police Nguyen Anh Tuan 2.65 million USD (equivalent to more than 61 billion VND) to bribe him not to prosecute. Of this amount, there is sufficient basis to determine that defendant Hoang Van Hung (former Head of Department 5, Security Investigation Agency, Ministry of Public Security) received 800,000 USD, the remaining 1.85 million USD for which Mr. Tuan must be responsible.

During the first instance trial, defendant Nguyen Anh Tuan influenced his family to pay 1.85 million USD to compensate for all the consequences. Defendant Tuan is currently serving a 4-year prison sentence for "bribery brokerage".

Defendant Hoang Van Hung, in particular, claimed his innocence during the first instance trial and was sentenced to life imprisonment by the Hanoi People’s Court for “fraudulent appropriation of property.” Defendant Hoang Van Hung later appealed his innocence.

However, before the appeal hearing, defendant Hung changed the content of his appeal, changing from claiming injustice to reducing his sentence, and at the same time influencing his family, relatives, and friends to pay 18.8 billion VND (equivalent to 800,000 USD) to remedy the consequences of the case.

The appellate court then reduced the sentence from life to 20 years in prison for defendant Hoang Van Hung.

Tan Hoang Minh Group paid more than 8,600 billion VND for fraud

Regarding violations at Tan Hoang Minh Group, according to the investigation conclusion, in the period of 2021 - 2022, due to the impact of the Covid-19 epidemic, the real estate market froze and bank credit was tightened.

The above context has caused Tan Hoang Minh Group to face many financial difficulties, with a huge credit balance, needing money to pay due and overdue debts, continuing to invest in buying and selling shares, projects, operating costs, etc.

To resolve the issue, defendant Do Anh Dung (Chairman of the Board of Directors and General Director of Tan Hoang Minh Group) agreed on the policy and directed individuals at Tan Hoang Minh Group to use the legal entity of 3 companies to fabricate business activities with "fake" contracts, to make a plan to issue individual bonds, thereby appropriating more than 8,600 billion VND from investors.

Also according to the case file, during the investigation, Tan Hoang Minh Group and related organizations coordinated and voluntarily remedied all consequences by depositing money into the temporary account of the investigation agency with a total amount of more than 8,600 billion VND.

This case has not yet been brought to trial.
