The Provincial People's Committee supports funding for localities to hire consulting units to determine specific land prices.

The Provincial People's Committee has just issued a decision approving support and additional funding to hire a consulting unit to determine specific land prices for districts, towns and cities. Accordingly, the level of funding support for hiring a consulting unit to determine specific land prices for cities, towns and districts in the plains and midlands is 50% of the funding requirement for implementation. Mountainous districts are supported with 70% of the funding requirement for implementation.

The total additional funding is more than 50.3 billion VND, of which the funding for 2023 is more than 16.98 billion VND; the provisional funding for 2024 is more than 33.37 billion VND. The funding source is taken from the economic career expenditure source (funds for hiring consultants to determine specific land prices according to Resolution No. 73/NQ-CP, dated May 6, 2023 of the Government on authorizing the decision on specific land prices) in the provincial budget estimate for 2024.

Based on the approved content in the decision and current regulations of the law, the Provincial People's Committee assigns the Department of Finance to preside over and coordinate with the Thanh Hoa State Treasury and related sectors and units to carry out additional professional procedures with the goal for the People's Committees of districts, towns and cities to perform assigned tasks in accordance with the provisions of law.

The People's Committees of districts, towns and cities shall, based on the assigned budget estimates, manage and use the budget in accordance with the regime, conditions, standards, norms, objectives and subjects, economically and effectively, prevent loss and waste and make payments and settlements in accordance with current legal regulations; at the same time, approve annual budget settlements according to their authority.

For the provisional funding source for 2024, the People's Committees of districts, towns and cities shall use it for the right purposes, ensuring compliance with the provisions of law. At the end of the budget year, the People's Committees of districts, towns and cities shall approve the final settlement of the funding for hiring a consulting unit to determine specific land prices in 2024, send it to the Department of Finance for synthesis, report to the Provincial People's Committee for consideration and approval of the remaining funding according to regulations.

According to the provisions of the 2024 Land Law, specific land prices are applied when calculating land use fees (SDĐ), land rent, calculating the value of land use rights, determining the starting price for auctioning land use rights and calculating compensation when the State reclaims land. Clause 1, Article 160 of the 2024 Land Law stipulates specific land prices applied to 6 cases.

Regarding the authority to decide on specific land prices, the Chairman of the Provincial People's Committee decides on specific land prices in cases of land allocation, land lease, permission to change land use purposes, recognition of land use rights, extension of land use, adjustment of land use term, adjustment of detailed construction planning, land recovery, determination of starting price for auction of land use rights, determination of value of land use rights when equitizing enterprises under the authority of the Provincial People's Committee.

The Chairman of the District People's Committee decides on specific land prices in cases of land allocation, land lease, permission to change land use purposes, recognition of land use rights, extension of land use, adjustment of land use term, adjustment of detailed construction planning, land recovery, and determination of starting price for auction of land use rights under the authority of the District People's Committee.

The agency with the function of land management is responsible for assisting the Chairman of the People's Committee at the same level in organizing the determination of specific land prices. During the implementation process, the agency with the function of land management is allowed to hire a land price consultancy organization to determine specific land prices.
