Dr. Tran Du Lich: The special mechanism only gives Ho Chi Minh City half of the power.

Resolution 98 allows Ho Chi Minh City to make decisions, but the implementation process and procedures are according to regulations, meaning it only gives half the rights, according to Dr. Tran Du Lich.

"Never before has the Central Committee of Ho Chi Minh City issued such a large resolution, but it itself is not consistent. The city has the right to make decisions and issue policies, but the procedures follow the regulations, meaning only half or a part is given," Dr. Tran Du Lich said at the meeting of the Steering Committee for the implementation of Resolution 98 of the National Assembly on piloting a number of special mechanisms and policies for the development of Ho Chi Minh City, on the afternoon of January 15.

Resolution 98, effective from August 1, 2023, will pilot a number of special mechanisms for Ho Chi Minh City for 3 years, expected to bring many benefits to the city's people and businesses. As Chairman of the Advisory Council for the implementation of this resolution, Dr. Tran Du Lich said that many contents of the special mechanism have been accelerated by the city, the remaining work is waiting for ministries and branches.

Speaking more clearly about the difficulties in implementing the special mechanism, Vice Chairman of the Ho Chi Minh City People's Committee Vo Van Hoan added that the issuance of a legal framework guiding some contents of Resolution 98 has not been on schedule. This has led to the city not having a basis to implement some policy contents according to regulations.

These include the Government's decrees on implementing BT contract projects; exemption of corporate income tax and personal income tax related to innovation and start-up activities; recruitment and management of cadres and civil servants working in communes, wards and towns; and decentralization of state management in a number of areas to Ho Chi Minh City.

"Up to now, these resolutions have not been issued," said Mr. Hoan. According to the city's leaders, there is currently no coordination mechanism between the city and ministries and branches when resolving difficulties in implementing Resolution 98. All recommendations must be reported directly to the Prime Minister, so in the long run, the role of members of the Steering Committee for Implementation cannot be promoted.

As head of the steering committee for implementing Resolution 98 at the Ho Chi Minh City level, Secretary of the City Party Committee Nguyen Van Nen said that it is necessary to apply all mechanisms and policies to decentralize more power to the city to ensure consistency with the resolution.

According to the head of the City Party Committee, it is necessary to apply Resolution 98 to handle the city's existing problems, thereby helping "the Ho Chi Minh City ship become lighter so that it can move forward, otherwise wherever it goes, it carries a big rock that makes it difficult to accelerate."

Before Resolution 98, in 2017, the National Assembly issued Resolution 54 with many specific mechanisms for Ho Chi Minh City to create new momentum for the city of 13 million people to make a breakthrough. However, after 4 years of implementation, the city has not received the expected results due to many obstacles from ministries and branches. Most of the specific policies on financial management to increase revenue such as equitization of state-owned enterprises and revenue from public asset auctions have not been implemented.
