The Government Inspectorate has just issued an inspection conclusion on land management in Hoai Duc district (Hanoi), including content related to investment in building the headquarters of the Party Committee, People's Council, and People's Committee of Di Trach commune.
Accordingly, the Government Inspectorate determined that this is a project using state budget capital, but the fact that the Commune People's Committee did not sign a contract with the District Project Management Board but signed a contract with a non-state organization as a project management consultant is not in accordance with regulations (for projects using state budget capital, the form of project management organization applied is the Construction Investment Project Management Board, specialized sector, Regional Construction Investment Project Management Board according to the provisions of Article 63 of the 2014 Construction Law and Article 17 of Decree 59/2015/ND-CP dated June 18, 2015 of the Government).
The inspection agency also pointed out that the inclusion of 650,000,000 VND in compensation for site clearance into the total investment without a plan or appraisal was not in accordance with regulations. At the same time, the payment of 27,879,000 VND was due to the unit price of manually excavating 194.46m3 of soil. The responsibility lies with the investor, the design consultant, the design appraisal unit, and the total estimate.
In addition, the project is late in settling payments according to regulations, the responsibility belongs to the investor.

The inspection conclusion shows that the People's Committee of Di Trach Commune hired Trong Tin Construction Investment Consulting Joint Stock Company to carry out the construction supervision consultancy package. In addition, Trong Tin Construction Investment Consulting Joint Stock Company also participated in a number of other projects and packages in Di Trach Commune. According to the inspection conclusion, Trong Tin Construction Investment Consulting Joint Stock Company has a relationship with the Commune Chairman. The Company's Director, Ms. Hoang Thi Thuy, has a relationship with the Commune Chairman's wife.
At the same time, Mr. Vuong Tat Manh, a company employee who is the younger brother of the wife of the Commune People's Committee Chairman, participated in supervising the construction of the Commune People's Committee Headquarters, leading to public concerns about the participation of the Commune Chairman's relatives in the project implementation. However, at that time, the above-mentioned relatives of the Commune Chairman in participating in the project implementation did not violate the provisions of the law.
From there, the Government Inspectorate requested the People's Committee of Hoai Duc district to direct the recovery to the local budget of 27,879,000 VND for incorrect unit prices, norms, and foundation excavation volume.
For the estimated cost of 650,000,000 VND for site clearance compensation, but the plan was not prepared, appraised and approved but was still included in the total investment, when approving the project settlement, it is necessary to review and if it is not suitable, it will be removed from the cost.
At the same time, request the People's Committee to review and examine the responsibility of the investor and relevant departments of the district in making mistakes in the process of establishing, appraising, approving, supervising, accepting, and settling construction works and handling organizations and individuals that caused violations according to regulations .
