Frankness and responsibility before the National Assembly's request for innovation

After a day of urgent, serious, democratic, intellectual and highly responsible work, the question and answer session on two areas of Justice and Agriculture and Rural Development at the 25th Session of the National Assembly Standing Committee ended successfully.

Speaking at the end of the question-and-answer session at the 25th session of the National Assembly Standing Committee (NASC), National Assembly Chairman Vuong Dinh Hue acknowledged that NA deputies, based on their working experience, had carefully prepared quality questions that closely reflected the reality, life, and aspirations of voters. They fully implemented regulations on the method of questioning, exchanging, and debating, ensuring the prescribed time.

The Ministers and Heads of sectors participating in the question-and-answer session, with a high sense of responsibility and a firm grasp of the current situation of their sectors and fields, explained and clarified the current situation and proposed many solutions to the issues questioned. The Standing Committee of the National Assembly and the National Assembly deputies highly appreciated the question-and-answer session, agreed with and acknowledged the solutions and commitments made at this question-and-answer session.

Judicial work has had many breakthroughs.

Regarding the field under the responsibility of the Ministry of Justice, the National Assembly Chairman stated that in recent times, with the attention of the Party and State, determination, responsible efforts, the judicial sector has achieved many comprehensive and important results.

Since the beginning of the 15th term, the Ministry of Justice has been more carefully prepared and innovated in the way it advises the Government to submit to the National Assembly for approval Resolutions on the annual law and ordinance building program, closely following Conclusion 19-KL/TW, Plan 81/KH-UBTVQH15 and the Law on Promulgation of Legal Documents.

The appraisal of draft laws and resolutions of the Ministry of Justice is systematic, responsible and of high quality. The Ministry of Justice and ministries, branches and localities have strengthened inspection and self-inspection of legal documents, detecting documents with errors and violations of regulations on form, content and authority. The number of documents processed is higher than in the previous period, contributing to ensuring the constitutionality, legality and consistency of the legal system. The effectiveness and efficiency of state management of asset auction activities have been improved. Basically, the implementation of judicial appraisal meets the requirements of litigation activities.

The National Assembly Chairman said that, in addition to the achieved results, the judiciary still has limitations such as the tendency to add projects to the Law-making Program not following the Overall Program or being proposed close to the time of the National Assembly session or the meeting of the National Assembly Standing Committee. Some projects have not been carefully studied in terms of scope of regulation and policy impact. The quality of some draft laws is not high, there are still conflicts, overlaps or unclear regulations, making it difficult to organize implementation. The lifespan of some decrees and circulars is very short, having to be amended and supplemented as soon as they are issued. The work of self-inspecting legal documents under the authority of some ministerial and provincial agencies has not been carried out seriously, fully, promptly and regularly...

The National Assembly Chairman requested the Government, the Minister of Justice, and relevant Ministers to fully absorb the opinions of the National Assembly deputies, resolutely direct, and implement the proposed solutions. In particular, regarding the work of formulating and implementing the Law and Ordinance Development Program, it is necessary to tighten discipline and order, and enhance responsibility in the law-making work, especially the responsibility of the leaders. Continue to thoroughly grasp and seriously implement the tasks, solutions, and requirements for innovation and improve the quality of law-making activities set forth in Conclusion No. 19-KL/TW and Plan No. 81/KH-UBTVQH15 and the resolutions and conclusions of the National Assembly Standing Committee on legislative work since the beginning of the term.

Focus on fundamentally overcoming the situation of slow dossiers, proposals for law and resolution drafting of the National Assembly that are not in accordance with the provisions of the Constitution and the Law on Promulgation of Legal Documents. Strictly control the development and promulgation of documents detailing and guiding the implementation of laws, ordinances and resolutions. Thoroughly overcome the situation of backlog, slow promulgation or detailed regulations.

Directing the synchronous and complete implementation of solutions to improve the quality of law-making work; enhancing the responsibility of legal agencies and organizations of ministries, branches and localities; ensuring resources for law-making work; proactively perfecting the legal organization, improving capacity, professional qualifications and paying attention to regimes and policies for this team. Strengthening the effectiveness and efficiency of power control, preventing and combating corruption, negativity, group interests and local interests in law-making work.

Regarding the work of inspecting legal documents, continue to thoroughly grasp the Party and State's orientations and requirements on building, perfecting, and organizing law enforcement, strictly implementing the Law on Promulgation of Legal Documents and legal documents on the work of building, perfecting institutions, and enforcing laws.

Strengthen the mechanism of social supervision and criticism, the role of the People's supervision in the work of building and promulgating legal documents. Strengthen the inspection, urging, direction and guidance of the Ministry of Justice in the work of checking and processing documents; at the same time, strengthen the work of self-inspection of documents of ministries, branches and localities.

Regarding asset auctions, focus on enhancing the effectiveness and efficiency of state management of auctions; regularly inspect and promptly handle violations and negative practices in asset auctions. Submit to the National Assembly for comments the draft Law amending and supplementing a number of articles of the Law on Asset Auctions at the 6th Session. Direct the completion of a team of auctioneers with sufficient numbers, professional qualifications and professional ethics; promote the application of information technology, and encourage online auctions.

Regarding judicial expertise, continue to effectively implement the Law on Judicial Expertise, complete detailed regulations and guidance documents on the implementation of the Law. Review and propose amendments and supplements to the Law on Judicial Expertise and related documents. Enhance the responsibility of agencies, organizations and individuals in performing judicial expertise; improve the effectiveness of coordination between competent agencies in state management of judicial expertise. Focus on inspection and examination, promptly detect and strictly handle violations. Do a good job of training and fostering, gradually perfecting the team of appraisers, ensuring sufficient quantity, professional qualifications and professional ethics to meet the requirements of performing tasks. Continue to perfect the mechanism for mobilizing resources to socialize and develop the field of judicial expertise.

Agriculture continues to be the mainstay of the economy

Regarding the areas under the responsibility of the Ministry of Agriculture and Rural Development (MARD), the National Assembly Chairman acknowledged that the agricultural sector has made many important contributions to the country's socio-economic development, continuing to be the pillar of the economy. The balance of supply and demand and national food security are firmly ensured; the supply and output of rice, meat and aquatic products have all increased compared to the same period last year, meeting domestic consumption and export.

The Government, the Minister of Agriculture and Rural Development and relevant ministries and localities have issued many documents under their authority to guide the implementation of the Fisheries Law and EC regulations on combating illegal, unregulated and unreported fishing (IUU); creating a legal basis for sustainable fisheries development.

However, the agriculture and rural development sector is currently facing many difficulties and challenges. Domestic market demand is recovering slowly, the agricultural export market is fluctuating, the number of orders is decreasing, prices of agricultural materials, fertilizers, and animal feed are increasing, the connection and regulation of supply and demand are still inadequate; the sustainable development of agriculture in general and the aquaculture sector in particular still faces many challenges...

From the issues raised, the National Assembly Chairman requested the Government, the Minister of Agriculture and Rural Development, and relevant Ministers and Heads of sectors to fully absorb the opinions of National Assembly deputies and resolutely direct the implementation of proposed solutions to overcome shortcomings and limitations.

The National Assembly Chairman pointed out solutions to overcome difficulties for agricultural products: Urgently complete policies and laws to develop brands and trademarks of key agricultural products. Update, analyze and evaluate information and market developments comprehensively and carefully to promptly disseminate and support people and businesses to overcome difficulties and take advantage of market opportunities. Strengthen existing markets and open new markets for Vietnamese agricultural products. Organize sustainable agricultural production.

Closely monitor the market developments and food prices in the world, have a plan to fully meet domestic rice demand, ensure food security, and meet increasing export demand; prevent the risk of "catching the export wave, leaving the domestic market vulnerable". It is necessary to take the factor of ensuring rice quality and brand, ensuring delivery progress as a "deep-rooted, lasting" solution.

Regarding exploitation, protection and sustainable development of aquatic resources, solutions to remove the EC's "yellow card" for aquatic products: Implement the Programs for investigation and comprehensive assessment of aquatic resources and aquatic habitats every 5 years. Adjust the structure of vessels for some occupations in the sea area in accordance with the allowable capacity of aquatic resources. Effectively organize the implementation of the Planning for protection and exploitation of aquatic resources for the period 2021 - 2030 (after approval), the National Program for protection and development of aquatic resources 2023 - 2030. Review, adjust and establish new marine reserves at the national and provincial levels. Develop policies for job conversion and livelihood conversion for fishing communities to other occupations. Manage seafood exploitation quotas well. Strengthen the fisheries control force; Strengthen inspection, control and strict handling of violations of the law in illegal mining, moving towards ending this situation.

Continue to negotiate, sign, and demarcate overlapping and undemarcated sea areas between Vietnam and other countries. Investigate and strictly punish cases of illegal fishing in foreign waters. Conduct traceability of exploited aquatic products; control imported aquatic products, especially imported by container ships. Focus on handling IUU violations. Continue to inform, communicate, propagate, train, and mobilize coastal fishing communities and relevant organizations and individuals to comply with legal regulations on IUU.

Regarding the conversion of land use purposes and land recovery for rice cultivation, ensuring food security: Urge the establishment and approval in 2023 of provincial planning, provincial land use plans; annual land use plans at district level; national sectoral planning, regional planning, urban planning, rural planning, technical and specialized planning related to land use, ensuring compliance with land use targets, synchronization and consistency with national land use planning and plans. Strictly control the conversion of rice cultivation land, especially land specialized in rice cultivation, to non-agricultural land, especially industrial park land. Strictly handle cases of land encroachment, conversion of land use purposes and illegal house construction. Harmonize the interests of all parties in the process of land conversion according to planning, especially ensuring the lives of people whose land is recovered.

The National Assembly Chairman stated that from the questions of the National Assembly deputies, many existing and pressing issues in society have been promptly considered and resolved; many policies have been issued, making important contributions to the country's socio-economic development and ensuring social security. Through the questioning activities, it also helps to discover shortcomings and limitations in the law enforcement process as well as enhance the responsibility of the Ministers in finding solutions to overcome the limitations and shortcomings; continuing to affirm that this is a very effective form of supervision by the National Assembly and the National Assembly Standing Committee.

The National Assembly Chairman expressed his belief that, with the solutions committed by the Ministers, with the high determination of the Government, the support of the National Assembly and the National Assembly Deputies, the management sector under the responsibility of the Ministry of Justice will have many clear changes, reaching new heights, becoming more substantial; the agriculture and rural development sector will overcome difficulties and challenges, continue to be a solid support for the economy, creating an important foundation and premise to move towards modern agriculture, international integration and adaptation to climate change.
