Strengthening management, publicity and transparency in land auction activities

(CLO) The People's Committee of Nam Dinh province has just issued Official Dispatch No. 691/UBND-VP6, requesting departments, branches and localities to strengthen State management of land use rights auctions to improve transparency and efficiency in auction implementation.

According to the assessment of the People's Committee of Nam Dinh province, in recent times, land use rights auction activities in the province have achieved many important results; auction activities have been carried out publicly and transparently; the effectiveness and efficiency of state management of asset auction activities in general and land use rights auctions in particular have been gradually improved, contributing positively to the collection of state budget and local socio-economic development.

However, land use rights auction activities in the area still exist and have limitations such as determining the starting price is not close to the market price; the quantity, quality, and capacity of units participating in organizing auctions and the auctioneer team are still limited; there are still potential complex factors that affect the quality of the auctions.

To overcome these shortcomings, the People's Committee of Nam Dinh province requested the heads of departments, branches, and chairmen of district and city People's Committees to continue to strengthen state management of land use rights auction activities in 2024 and the following years.

In particular, the Department of Justice continues to improve the quality of propaganda and dissemination of laws on property auctions; strengthen inspection, examination and supervision, ensuring that auctions are conducted in accordance with regulations, without collusion or collusion; violations will be strictly handled, in order to enhance publicity, transparency and fairness.

The provincial police coordinate to ensure security and order at auctions, especially large auctions with potentially complicated elements; actively combat and handle violations of the law related to auctions.

The State Bank of Vietnam, Nam Dinh province branch, directs commercial banks and credit institutions to ensure accuracy and keep confidential information about the depositor and auction participants when conducting transactions regarding deposits for participating in property auctions according to regulations.

Nam Dinh Provincial People's Committee also requested the Department of Natural Resources and Environment and the Department of Finance to coordinate and guide districts and cities to organize land auctions in accordance with regulations.

Relevant departments and branches regularly review and edit legal documents to ensure consistency and suitability with reality.

The People's Committees of districts and cities strictly implement the provisions of the Law on Property Auction, the Land Law, the Law on Management and Use of Public Assets and related legal provisions, regulations and directions of the Provincial People's Committee in land use rights auction activities in the area; encourage the selection of online auction forms to ensure publicity, transparency, objectivity and efficiency.

Units and organizations that auction assets in the province must strictly comply with the auction procedures as prescribed by law; must ensure honesty and objectivity and must not collude or suppress prices; and supervise the auction team to ensure compliance with professional ethics.

Agencies and units shall seriously and promptly report difficulties and problems to the Provincial People's Committee for consideration and resolution; ensure that the auction of land use rights in the province takes place openly, transparently, effectively, and positively contributes to the sustainable development of the locality.
