Which legal documents in the field of education will be abolished?

According to the Ministry of Education and Training, before this draft, the Legal Department of the Ministry coordinated with units within the Ministry to regularly review and systematize legal documents in the field of education to detect documents that are no longer consistent with the legal system, outdated documents, no longer feasible, or expired, thereby recommending handling in accordance with the provisions of law.

Specifically, the Ministry of Education and Training proposed to abolish 6 legal documents, including:

Circular No. 23 of the Ministry of Education and Training dated July 23, 2010 promulgating Regulations on the Development Standards for 5-year-old Children.

The set of standards for the development of 5-year-old children (Circular 23) has been included in the circular promulgating the preschool education program, so Circular 23 is proposed to be abolished.

The Ministry of Education and Training explained that in recent years, the implementation of Circular 23 has basically met the purpose of supporting the implementation of preschool education programs for 5-year-old children in preschool institutions.

However, through inspection, monitoring and reporting by localities, the simultaneous implementation of two documents (both a circular promulgating the preschool education program and a circular promulgating the set of standards) causes difficulties for preschool education facilities (easily generating records and books), while the content of the set of standards has been transformed into the preschool education program.

To streamline documents and create favorable conditions for preschool teachers and preschool education facilities, the Ministry did not issue a circular on the new set of standards for the development of 5-year-old children, but issued a separate decision by the Minister of Education and Training approving the set of standards for the development of 5-year-old children so that organizations and individuals can flexibly use it for different purposes.

Joint Circular No. 13 between the Ministry of Education and Training, the Ministry of Finance and the Ministry of Health dated March 16, 1999 guiding the implementation of the medical service regime for foreign students studying in Vietnam. The reason is that some articles of this circular are no longer consistent with the Law on Health Insurance (amended and supplemented in 2014).

For example, the Law on Health Insurance stipulates that foreigners studying in Vietnam who are granted scholarships from the Vietnamese state budget are eligible to participate in health insurance paid for by the state budget and have their medical examination and treatment costs paid by the health insurance fund within the scope of benefits at a rate of 80% of the medical examination and treatment costs.

Joint Circular No. 13 between the Ministry of Education and Training, the Ministry of Labor, Invalids and Social Affairs, the Politburo, the Ministry of Home Affairs and the Ethnic Committee dated April 7, 2008 guiding the implementation of a number of articles of Decree No. 134/2006/ND-CP dated November 14, 2006 of the Government regulating the recruitment regime for university, college and intermediate level educational institutions in the national education system.

The reason for the abolition is that this decree has expired due to Decree No. 141 dated December 8, 2020 of the Government. The contents of the election regime have many new regulations on subjects as well as related policies.

Circular No. 22 of the Ministry of Education and Training dated May 30, 2011 promulgates regulations on scientific and technological activities in higher education institutions. Accordingly, the Law on Higher Education was amended and supplemented in 2018 to stipulate that "The Government regulates scientific and technological activities in higher education institutions". Currently, the content of Circular No. 22 has been included in Decree No. 109/2022 of the Government regulating scientific and technological activities in higher education institutions.

Decision 28 dated August 30, 2005 of the Ministry of Education and Training temporarily promulgates the Khmer language program in primary and secondary schools. The content of the Khmer language program in primary and secondary schools is currently being implemented according to the provisions of Circular No. 34 dated September 15, 2020 of the Minister of Education and Training promulgating the general education program for Bahnar, Cham, Ede, Jrai, Khmer, Mong, Mnong, and Thai languages.

Joint Circular No. 35 dated April 21, 1994 of the Ministry of Education and Training and the Ministry of Finance guiding the management of education and training budgets is also proposed to be abolished. The reason is that the documents basing on the issuance of Joint Circular No. 35 have now been replaced by the provisions of the State Budget Law 2015.
