The Government issued Decree No. 42/2025/ND-CP dated February 27, 2025 stipulating the functions, tasks, powers and organizational structure of the Ministry of Health.
According to the Decree, the Ministry of Health is a Government agency, performing the function of state management in the following fields: Preventive medicine; medical examination, treatment, rehabilitation; medical examination, forensic medicine, forensic psychiatry; mothers and children; population; prevention and control of social evils (except for drug addiction treatment and post-drug addiction treatment management); social protection; traditional medicine and pharmacy; pharmaceuticals and cosmetics; food safety; medical equipment; health insurance and state management of public services in the fields under the state management of the Ministry of Health.
31 groups of tasks and powers
The Ministry of Health performs the tasks and powers prescribed in the Law on Organization of the Government, Government regulations on functions, tasks, powers and organizational structure of ministries and ministerial-level agencies, and performs the following specific tasks and powers:
1. Submit to the Government draft laws, draft resolutions of the National Assembly, draft ordinances, draft resolutions of the National Assembly Standing Committee, draft decrees and resolutions of the Government according to the approved annual law-making programs and plans of the Ministry of Health and programs, projects and proposals as assigned by the Government and the Prime Minister; submit to the Government and the Prime Minister for approval strategies, planning, long-term, medium-term and annual development plans and important national programs, projects and works in areas under the state management of the Ministry of Health.
2. Submit to the Prime Minister draft decisions, directives and other documents on areas under the state management of the Ministry of Health or as assigned.
3. Issue circulars, decisions, directives and other documents on state management of areas under the state management of the Ministry of Health.
4. Direct, guide and organize the implementation of legal documents, strategies, planning, plans, national target programs, programs, projects and important national works after approval; inspect, review, systematize, consolidate and codify the system of legal documents, propagate, disseminate and educate the law and monitor the implementation of the law in the fields under the state management of the Ministry of Health.
5. Regarding preventive medicine: Develop, promulgate or submit to competent authorities for promulgation professional regulations, national standards, national technical regulations, economic and technical norms on: Monitoring, prevention and control of infectious diseases, HIV/AIDS, non-communicable diseases, occupational diseases, accidents and injuries; vaccination; biosafety in medical laboratories; border medical quarantine; environmental health and hygiene, occupational hygiene, health and hygiene of agencies and schools; community nutrition; prevention and control of harmful effects of tobacco; prevention and control of harmful effects of alcohol and beer; quality of clean water used for domestic purposes; management of chemicals, insecticides and disinfectants used in the household and medical fields, etc.
6. Regarding medical examination, treatment and rehabilitation, medical examination, forensic examination, forensic psychiatric examination: Develop, promulgate or submit to competent authorities for promulgation regulations on technical expertise, national standards, national technical regulations, economic - technical norms, quality criteria on: medical examination, treatment, out-of-hospital emergency, blood transfusion safety, nursing, rehabilitation, clinical pharmacy, clinical nutrition, infection control; cosmetic surgery; donation, collection, transplantation of human tissues and organs; medical examination, forensic examination, forensic psychiatric examination according to the provisions of law...
7. Regarding mothers and children: Develop, promulgate or submit to competent authorities for promulgation legal documents, strategies, policies, programs, plans, and national goals on mothers and children...

19. Develop programs, plans and direct, guide, organize and inspect the implementation of communication work, health education and information provision work in the health sector.
20. State management of public services in areas under the state management of the Ministry of Health according to the provisions of law; develop, promulgate or submit to competent authorities for promulgation mechanisms and policies on the provision of public career services in areas under the state management of the Ministry of Health...
21. Guide and organize the implementation of legal regulations on price management of services and goods in areas under the state management of the Ministry of Health according to the provisions of law.
22. Preside over and coordinate with relevant agencies to prevent, combat, provide emergency aid and treat victims of natural disasters and catastrophes.
23. Develop plans and organize the implementation of national reserves of drugs, chemicals, medical equipment, means of disease prevention and control, natural disasters according to the list of national reserves decided by the Government and in accordance with the provisions of law.
24. Manage associations and non-governmental organizations operating in fields under the state management of the Ministry in accordance with the provisions of law.
25. Develop and direct the implementation of the Ministry of Health's administrative reform plan according to the goals and contents of the Government's overall program on state administrative reform.
26. Carry out international cooperation and international integration in areas under the state management of the Ministry of Health in accordance with the law. Organize negotiations and sign international treaties in accordance with the law and authorization of competent state agencies; preside over and coordinate the signing of international agreements on behalf of the Ministry of Health in accordance with the law; participate in international organizations as assigned by the Government.
27. Manage the organization, civil servant payroll, number of employees, job positions, civil servant rank structure, and employee structure according to professional titles; decide on rotation, transfer, appointment, dismissal, resignation, removal from office, secondment, commendation, discipline, termination, retirement; implement salary regimes and preferential policies; organize training and fostering for cadres, civil servants, public employees, and workers under the management authority of the Ministry of Health according to the provisions of law.
28. Manage assigned finances and assets and organize the implementation of allocated budgets according to the provisions of law; manage the Tobacco Harm Prevention Fund according to the provisions of law.
29. Inspect and examine the performance of functions, tasks, powers and the implementation of policies and laws of agencies, organizations and individuals; perform administrative inspection tasks for agencies, organizations and individuals under the management of the Ministry of Health...
30. Develop and promulgate a system of statistical indicators and statistical reporting regimes of the health sector in accordance with the provisions of law; organize the collection, synthesis, analysis, management and storage of statistical information of the health sector; develop a national database of the health sector.
31. Perform other tasks and powers assigned by the Government, the Prime Minister and as prescribed by law.
The organizational structure consists of 20 units.
The Decree clearly states that the organizational structure of the Ministry of Health includes 20 units:
1. Health Insurance Department.
2. Department of Organization and Personnel.
3. Department of Planning and Finance.
4. Legal Department.
5. Department of International Cooperation.
6. Ministry office.
7. Ministry Inspector.
8. Department of Medical Examination and Treatment Management.
9. Department of Traditional Medicine Management.
10. Department of Drug Administration.
11. Food Safety Department.
12. Department of Infrastructure and Medical Equipment.
13. Department of Science, Technology and Training.
14. Population Department.
15. Department of Disease Prevention.
16. Department of Maternal and Child Health.
17. Department of Social Protection.
18. Institute of Health Strategy and Policy.
19. National Health Information Center.
20. Health and Life Newspaper.
The organizations specified from 1 to 17 are organizations that assist the Minister in performing state management functions; the organizations specified from 18 to 20 are public service units serving the state management functions of the Ministry of Health.
The Department of Planning and Finance has 5 divisions.
The Minister of Health shall submit to the Prime Minister for promulgation a list of other public service units under the Ministry of Health according to regulations.
The Minister of Health issues a decision stipulating the functions, tasks, powers and organizational structure of organizations and units under the Ministry of Health.
This Decree comes into force from March 1, 2025.
Decree No. 95/2022/ND-CP dated November 15, 2022 of the Government stipulating the functions, tasks, powers and organizational structure of the Ministry of Health ceases to be effective from the effective date of this Decree.
