The National Assembly discussed in the hall the draft Law on Electricity (amended)

According to the meeting agenda, on November 7, the National Assembly discussed the draft Law on Electricity (amended). Discussing at the meeting, delegate Dang Thi My Huong, Deputy Head of the National Assembly Delegation (NAD) of Ninh Thuan province, agreed with the necessity of amending the Law on Electricity; at the same time, proposed to add regulations to reform the modern and worthy electricity market.

Participating in giving comments on the draft law on State policies on electricity development in Article 5, the draft law stipulates 15 clauses, providing many electricity development policies for each field... Delegate Dang Thi My Huong said that such regulations are scattered, and it is feared that they will not ensure State resources to implement all policies stipulated in the draft law. It is recommended that the drafting agency review the general regulations of general policies; it is necessary to calculate to ensure feasibility so that the provisions of the law must come into life and must be strictly implemented.

Next, amending a number of articles of the Electricity Law this term, the drafting agency included regulations on nuclear power development policies; accordingly, the drafting agency stipulated only 1 clause, clause 14, article 5, with 5 points providing many regulations on nuclear power development, such as: Nuclear power development planning; investment subjects; construction, operation, termination of operations and safety assurance of nuclear power plants; regulations on the use of technology of nuclear power projects. All of these regulations only imply a few lines, and how the specific regulations are implemented is unclear.

Delegate Dang Thi My Huong, Deputy Head of the National Assembly Delegation (NAD) of Ninh Thuan province, spoke at the discussion in the hall.

According to delegate Dang Thi My Huong, developing nuclear power and investing in the construction of nuclear power plants, but only regulating a few points, in 1 clause in 1 Article like that, is very worrying. Studying the review report of the National Assembly's Committee on Science, Technology and Environment, it was determined that this is a new issue regulated in this draft Law and the National Assembly's Committee on Science, Technology and Environment has requested the drafting agency to report to the competent authority to consider and decide on the regulations of the contents in clause 14; it is necessary to have a dose of content and level of regulation in the draft Law.

Next, at point d, clause 14, Article 5 of the draft law stipulates: "Depending on the economic and social situation of each period and specific projects, the Prime Minister shall prescribe specific mechanisms to ensure effective implementation of investment in construction and operation of nuclear power plants". Thus, according to the provisions at this point, the authority is assigned to the Prime Minister. The National Assembly does not discuss the construction of nuclear power plants.

Therefore, delegate Dang Thi My Huong suggested that the National Assembly should consider this provision. Studying the Inspection Report of the National Assembly's Committee on Science, Technology and Environment, the inspection confirmed that this is not in accordance with the Prime Minister's authority as prescribed by the Law on Government Organization and not in accordance with Article 20 of the Law on Promulgation of Legal Documents (Article 20: Decision of the Prime Minister The Prime Minister issues a decision to stipulate: Measures for leading and managing the activities of the Government and the state administrative system from the central to local levels, working regimes with members of the Government, local authorities and other issues under the Prime Minister's authority; Measures for directing and coordinating the activities of members of the Government; inspecting the activities of ministries, ministerial-level agencies, agencies under the Government, local authorities in implementing the Party's guidelines and policies, and the State's policies and laws). Delegate Huong suggested that the National Assembly pay attention to reviewing this provision.

Also according to delegate Dang Thi My Huong, in order for the research and development of nuclear power to firmly ensure national energy security and sustainable development, meeting the goal of net zero emissions by 2050. It is necessary to research, develop and perfect legal regulations on nuclear power that are complete, strict, synchronous and unified; stipulate specific mechanisms and policies to ensure the legal basis for the development of nuclear power to be successful and highly effective. It is necessary to determine a specific roadmap for nuclear power development, avoiding wasting invested state resources and land resources at the two locations where in 2009 the National Assembly issued a Resolution on investment policy to build Ninh Thuan Nuclear Power Plant 1 and 2. Seven years later, in 2016, the National Assembly issued a Resolution to stop the investment policy for 2 nuclear power plants in Ninh Thuan. In December 2023, the National Assembly and the Government allocated capital to Ninh Thuan to build infrastructure to stabilize the lives of people in the two project areas. Regarding investment in nuclear power development, it is recommended that there should be a unified policy and implementation to ensure consistency, synchronization, and efficiency, creating trust for the people.

Concluding the discussion, delegate Dang Thi My Huong emphasized that Ninh Thuan has potential for energy and renewable energy development, which has been identified by the Government as the country's renewable energy center according to Resolution 115/NQ-CP dated August 31, 2018, and energy and renewable energy are the province's number 1 important pillar industry in the provincial planning; in the process of implementing the electricity development strategy, it is necessary to study and propose building Ninh Thuan into a "Green and clean industrial center" to create competitive advantages for Ninh Thuan as well as for the country in socio-economic development in the coming time.
