Attracting development resources
Speaking with Kinh te & Do thi Newspaper, Deputy Director of the Hanoi Department of Justice Nguyen Cong Anh said that the Capital Law was passed by the National Assembly at the 7th Session on June 28 and on July 23, the Office of the President announced the President's Proclamation Order on the Capital Law and several other laws.
The Capital Law was developed in the context that the 2012 Capital Law has not yet resolved and met the needs of construction and development of the Capital and the Capital region. Therefore, it is necessary to amend and supplement specific policy mechanisms. These specific policy mechanisms are stated in Resolution No. 15-NQ/TW of the Politburo on the direction and tasks of developing the Capital Hanoi until 2030, with a vision to 2045, and this Capital Law has institutionalized all the requirements of Resolution 15 under the direction of the Politburo.
Notably, the 2024 Capital Law contains many contents decentralizing the power of central agencies to Hanoi City. For example: investment mechanism, construction of urban railways in the direction of developing public transport system, rural development. Meanwhile, the 2012 Capital Law does not have the content of rural development.
"At the same time, the Capital Law 2024 stipulates a controlled testing mechanism for technologies, products, services, and business models that are not yet regulated by law, not yet permitted to be implemented, or licensed for a limited period. This is a new regulation that the current legal system has not yet mentioned," said Nguyen Cong Anh, Deputy Director of the Hanoi Department of Justice.
According to Deputy Director of the Department of Justice Nguyen Cong Anh, the Capital Law 2024 continues to supplement existing financial mechanisms such as: mobilizing financial resources and urban development planning, traffic development. These are contents that were mentioned in the Capital Law 2012 but this time continue to supplement and clarify to create conditions for development.
A very important content of the Capital Law 2024 is to promote the leading role of the Capital - the content on regional linkage, regulations for the Capital to use its budget to support related provinces and invest in surrounding provinces. These are contents that clearly demonstrate the policy of the Capital being the leading role of the region as well as the whole country to attract development resources.
To put the provisions of the Capital Law into practice
“To implement the Capital Law 2024, right from the 7th Session of the 15th National Assembly, the leaders of the Hanoi People's Committee have paid attention and directed the Department of Justice - the agency assigned by the Hanoi People's Committee to advise, propose and synthesize the contents of the Capital Law. From there, the unit has developed a detailed plan to send to departments and branches for comments" - Deputy Director of the Department of Justice Nguyen Cong Anh shared.
According to Deputy Director of the Department of Justice Nguyen Cong Anh, the Capital Law 2024 has many mechanisms and policies that are superior to current institutions, creating conditions for the capital to develop. However, if we do not institutionalize and make efforts in organizing implementation, it will not be able to promote much. Learning from experience, the Capital Law 2012 stipulates too many general policies, which are framework-based and difficult to apply; however, this Capital Law stipulates very specific regulations.
Therefore, the plan includes the content of thoroughly informing State agencies in the capital, civil servants, and people of the capital to clearly understand the provisions of the Capital Law, and to make efforts to join hands to realize it in the city's program. The institutionalization of the contents of the Capital Law is assigned to the Government, ministries, branches, People's Council, and People's Committee. At the same time, review the documents issued by Hanoi City before implementing the Capital Law 2024.
“All departments and branches must review, if not suitable, they must be adjusted immediately or newly issued. When documents are issued and implemented, they must be evaluated annually to promptly adjust, so that the provisions of the Capital Law can be put into practice. If they are not suitable, we must propose adjustments immediately, especially the detailed regulations” - Deputy Director of the Hanoi Department of Justice Nguyen Cong Anh informed.
With many new and progressive points, the Capital Law 2024, effective from January 1, 2025, is considered an important legal corridor for Hanoi to become the development locomotive of the whole country. The passing of the Capital Law 2024 is not only great news for the government and people of the Capital, but also brings expectations and desires for strong changes, meeting the expectations of the whole country for a worthy development of the Capital in the future.
Because the breakthrough, unique and outstanding mechanisms in the Law will contribute to overcoming difficulties, obstacles and institutional shortcomings arising in practice, creating the basis for building and developing the Capital with the position and role as a political, administrative, economic and cultural center, towards a smart, modern, green, clean, beautiful, secure and safe urban area; developing rapidly, sustainably, with a spreading power to promote the development of the Red River Delta, the key economic region of the North and the whole country.
