On the evening of October 2, Dong Nai Police coordinated with the Criminal Police Department, Ho Chi Minh City Police, and Long An Provincial Police to arrest Nguyen Thanh Son (born in 1989, residing in Nhi Thanh Commune, Thu Thua District, Long An Province), the suspect in the kidnapping of a 3-year-old girl.
According to lawyer Dang Van Cuong, the suspect in the kidnapping of a 3-year-old girl in Long An could face up to 20 years in prison or life in prison.
On the afternoon of October 3, answering VTC News, Dr. and lawyer Dang Van Cuong - Member of the Executive Committee of the Vietnam Association for the Protection of Children's Rights - said that initial information showed that the suspect's behavior in kidnapping the 3-year-old girl to appropriate her property was reckless and disregarded the law, so he would receive severe punishment.
In this case, the suspect's act of kidnapping the child and demanding ransom from the family is an act of appropriating property, satisfying the signs of constituting a crime as prescribed in Article 169 of the Penal Code.
“The suspect's actions infringe upon many subjects protected by criminal law, including children's rights, children's rights to physical and life protection, citizens' rights to freedom of movement and residence, and illegal infringement upon citizens' rights to property ownership.
The kidnapper's actions caused panic in public opinion and fear and anxiety for the child's family," said lawyer Cuong.
According to information from the Investigation Agency, after kidnapping the child, the kidnapper asked the child's family to pay 2 billion VND in advance, and in reality, he took 1 billion VND.
Although the suspect left the child at the hotel and was arrested while fleeing, this act still satisfied the criminal elements of kidnapping for the purpose of appropriating property.
"The kidnapper's actions will be handled according to the provisions of Clause 4, Article 169 of the Penal Code with a possible penalty of up to 20 years in prison or life imprisonment," added lawyer Cuong.
According to lawyer Cuong, in theory, the crime of kidnapping for the purpose of appropriating property is a crime with formal elements, the crime is completed from the moment the suspect captures the child and demands ransom from the family, regardless of whether the suspect gets the money or not, how much money he gets, and whether the child is returned to the family or not.
The crime is the act of kidnapping one person for the purpose of appropriating another person's property. The kidnapped people are often vulnerable people such as children, women, the elderly or people who are unable to defend themselves.

“The crime of kidnapping for the purpose of appropriating property not only illegally and blatantly violates citizens' legitimate property rights but also threatens to infringe upon the life and health of the hostage.
There have been cases where, after carrying out a kidnapping to seize property, the kidnapper brutally killed the hostage and escaped, or killed the hostage and then committed suicide," said lawyer Cuong.
According to lawyer Cuong, in this case, although the suspect has not violated the child's life or health, his actions have caused disorder, insecurity, and social safety, and caused anxiety in the community, so this kidnapper will have to face severe punishment under the law.
According to the suspect's statement, the purpose of kidnapping his best friend's daughter was to get money to pay off debt and then become a monk.
As reported by VTC News, at around 3:00 p.m. on October 2, at the kindergarten in Kien Phat residential area (Ward 6, Tan An City, Long An Province), a girl named LMC (3 years old, residing in Ward 2, Tan An City) was picked up by a man and then taken away.
After picking up the girl, the suspect put her in a car and drove to Hamlet 6 (Nhi Thanh Commune, Thu Thua District, Long An Province). At 4 p.m., the suspect drove the girl back to Ho Chi Minh City. He then repeatedly used his phone to text the girl's parents, asking them to quickly transfer the ransom of 2 billion VND.
In response to the above incident, Long An Provincial Police quickly coordinated with the Criminal Police Department (Ministry of Public Security), Ho Chi Minh City Police and Dong Nai Provincial Police to track down the fugitive suspect.
At 9:20 p.m. on October 2, at KM57, National Highway 20, passing through Tan Phu town, Tan Phu district, Dong Nai Provincial Police discovered and arrested Nguyen Thanh Son while he was hiding on a Phuong Trang passenger bus traveling in the direction of Dong Nai - Lam Dong.
