Rearview mirrors are considered an important part to ensure the safety of the vehicle. In terms of function, rearview mirrors help drivers observe vehicles traveling in the same direction behind. Before making decisions to change direction or cross the road, the rearview mirror is a powerful assistant that the driver needs to observe.
According to Point e Clause 1 and Clause 2 Article 53 of the 2008 Road Traffic Law, it is stipulated that:
Automobiles of the correct type allowed to participate in traffic must have adequate rearview mirrors and other equipment and devices to ensure visibility for the driver.
Two-wheeled motorcycles, three-wheeled motorcycles, and motorbikes must also have adequate rearview mirrors and other equipment and devices to ensure visibility for the driver.
Further explanation, standard QCVN 28:2010/BGTVT states that the rearview mirror of a motorbike or scooter is a part designed to observe the rear.
Accordingly, all rearview mirrors of the vehicle must be securely installed and have adjustable viewing areas. The driver can easily adjust them at the driving position and can clearly see the image behind with a minimum distance of 50m to the right and left. At the same time, the rearview mirrors must meet the following size regulations:
- The area of the reflecting surface must not be less than 69cm2.
- In case of circular mirrors, the diameter of the reflecting surface must not be less than 94mm and must not be greater than 150mm;
- In the case of a non-circular mirror, the size of the reflecting surface must be large enough to contain an inscribed circle with a diameter of 78mm, but must fit within a rectangle measuring 120mm x 200mm.
When participating in traffic, if a motorbike does not have enough rearview mirrors, the traffic police will have the right to stop the vehicle for inspection according to regulations by directly detecting violations. At that time, the driver participating in traffic must comply with the regulations on stopping the vehicle.
The fine for vehicles not having rearview mirrors when participating in traffic is stipulated in Decree 100/2019/ND-CP as follows:
For motorbikes, according to Point a, Clause 1, Article 17 of Decree 100, the fine for motorbikes without a left mirror or having one but it is not effective is from 100,000 to 200,000 VND.
According to Point a, Clause 2, Article 16 of Decree 100/2019/ND-CP, the fine is from 300,000 to 400,000 VND for cars (including trailers or semi-trailers) and similar vehicles that do not have rearview mirrors when participating in traffic. Not only that, the traffic police will apply an additional penalty of requiring the driver to install full equipment or replace it with qualified equipment.
Thus, to be eligible to participate in traffic, motorbikes must have rearview mirrors on the left side or on both sides and cars must have rearview mirrors on both sides; failure to do so will result in administrative penalties according to the provisions of law.
