Big changes compared to the 2012 Capital Law
According to Deputy Head of the National Assembly's Law Committee Nguyen Phuong Thuy, the Draft Law on the Capital (amended) consists of 7 chapters and 54 articles, which is a huge change compared to the 2012 Law on the Capital. The proposed policies basically follow the guiding spirit of Resolution No. 15-NQ/TW dated May 5, 2022 of the Politburo, demonstrating the uniqueness and superiority, creating a foundation and basis for the development of the Capital.
"Through monitoring the process of completing the Draft Law, we see that the Draft Law has demonstrated policies that create a basis for the city government to continue to propose and perfect the system of solutions and measures in the field of state management in general as well as focusing on solutions on resource mobilization, investment, planning, policies for developing culture, education, health, and social security fields... In particular, there are strong solutions to help Hanoi overcome current shortcomings in landscape, urban construction, traffic, and environmental pollution..." - said the Deputy Chairman of the National Assembly's Law Committee.
The draft Law on the Capital (amended) has many outstanding and specific policies related to many comprehensive fields. According to the Deputy Chairman of the National Assembly's Law Committee, in order for these policies to be put into practice and effectively implemented, we need capable and enthusiastic people. Therefore, the delegates are very interested in the regulations on perfecting the urban government apparatus in Hanoi, which is also a new content compared to the 2012 Law on the Capital.
Stronger decentralization for cities
According to Deputy Head of the National Assembly's Law Committee Nguyen Phuong Thuy, the Draft Law on the Capital (amended) has a separate chapter on urban government in Hanoi with many different mechanisms compared to the current Law on Organization of Local Government.
Specifically, the Draft Law is expected to decentralize more strongly to the People's Council and People's Committee of the city to decide on issues related to the organizational apparatus; have policies related to the management of cadres, civil servants, public employees, attracting talented people; policies on payroll, salary, income...
The provisions in the Draft Law are quite open, giving relatively broad powers to the city government. To solve problems related to traffic congestion, the Draft Law includes provisions allowing the People's Council to prescribe and implement solutions and measures to control personal vehicles in the inner city, prescribe low emission zones, and reduce environmental pollution caused by vehicles...
Along with that, solutions related to urban planning, renovation and reconstruction are also of interest, but the Draft Law only sets out general legal frameworks, mainly decentralizing power to localities to implement comprehensive, synchronous solutions and appropriate roadmaps depending on management requirements in each stage and local resources.
Regarding traffic, Deputy Head of the National Assembly's Law Committee Nguyen Phuong Thuy said that one of the contents of the Draft Law stipulates focusing on developing public transport according to the TOD model. With this provision, Hanoi has more room to solve current traffic congestion and concerns.
Creating position and strength for the Capital in the new development stage
According to Nguyen Phuong Thuy, Vice Chairman of the National Assembly's Law Committee, when we develop urban areas with good living conditions, convenient transportation, and guaranteed environmental, landscape, and infrastructure conditions, people's habits will change. Then, they will not choose to live in cramped areas, small alleys, and unsafe living conditions...
At the same time, the Draft Law also has provisions related to urban renovation and reconstruction, which proposes stronger policy solutions than current legal regulations to re-plan and reconstruct each area in the inner city. Areas with high population density and high construction density can be rearranged; encroachment and construction areas at risk of collapse can be handled. Current solutions are available but not really strong.
Noting that when the Law on the Capital (amended) was passed, Deputy Chairman of the National Assembly's Law Committee Nguyen Phuong Thuy said that through monitoring the discussion process of delegates at the 6th Session, at the conference of specialized National Assembly delegates, through direct exchanges, delegates basically supported the content of the Draft Law, especially with special and specific policies because there is only one Capital. The Capital needs special requirements for management and development.
The Law on the Capital (amended) will have many advantages, however, the passing of the Law is just the first step, because this is a law on decentralization. The work that the Hanoi City government will have to carry out is huge. "The draft Law has up to 80 contents on decentralization and supplementation for the city government. The volume of legal documents that need to continue to be issued to specify these mechanisms and policies is very large" - said the Deputy Chairman of the Law Committee of the National Assembly.
The Vice Chairman of the National Assembly's Law Committee also expressed his hope that in the coming time, the Government, the Prime Minister, central ministries and branches, especially the Party Committee and the Hanoi City government will focus on researching and proposing specific solutions to implement the "opening" policies in the Capital Law (amended). Together with the Hanoi Capital Planning for the period 2021 - 2030, with a vision to 2050 and the Project to Adjust the Hanoi Capital Master Plan to 2045, with a vision to 2065, which were commented on by the National Assembly, these will be important legal foundations and bases to create position and strength for the Capital in the new development period, so that the Capital is truly Cultural - Civilized - Modern.
