The human resources serving the operation and management of the National Data Center are basically the existing team of people working in data processing and management of the Ministry of Public Security without creating additional staff.

On the afternoon of November 15, continuing the 39th Session, the National Assembly Standing Committee gave opinions on explaining, accepting, and revising the draft Law on Data.
Vice Chairman of the National Assembly, Senior Lieutenant General Tran Quang Phuong chaired the meeting.
Reporting on a number of major issues regarding the explanation, reception, and revision of the draft Law on Data, Chairman of the National Defense and Security Committee Le Tan Toi said that regarding the name and scope of the draft Law, the Standing Committee of the National Defense and Security Committee has coordinated to review and revise the provisions on the scope of the draft Law in the direction of regulating digital data.
Regarding the transfer of data abroad to foreign organizations and individuals (Article 25), the Standing Committee of the National Defense and Security Committee finds that this is a new and complicated content, with different opinions, and currently a number of representative agencies, foreign organizations and enterprises have sent their opinions and recommendations.
To ensure feasibility, suitability with practice and flexibility in the management process, the Standing Committee of the National Defense and Security Committee proposes to only stipulate basic, principled contents in the draft Law and assign the Government to specify details.
Regarding the construction of the National Data Center and the national comprehensive database (Article 40), the National Data Center is invested with the state budget, including the national comprehensive database to provide infrastructure for ministries, branches, and localities, and the Minister of Public Security is assigned to prescribe the functions, tasks, powers, and organizational structure.

Therefore, the Standing Committee of the National Defense and Security Committee proposed to keep the regulations on building the National Data Center as the draft Law submitted by the Government.
Discussing at the meeting, opinions assessed that this is a new and very difficult law project. The drafting agency and the reviewing agency have conducted thorough research, consulted international experience, closely coordinated with relevant agencies, and concretized 4 important policies proposed in law making.
Delegates also highly appreciated the drafting agency and the Standing Committee of the National Defense and Security Committee for their coordination and serious implementation of the viewpoints on innovation in thinking, methods, processes, and legislative procedures of General Secretary To Lam as well as the direction of the National Assembly Chairman to absorb and revise the draft Law on Data.

Vice Chairman of the National Assembly Nguyen Khac Dinh said that this is a very important law project. When promulgated, it will be a legal tool, an important legal basis for promoting national digital transformation, contributing to raising the national digital transformation ranking, helping to digitally transform sectors, levels, and localities.
Vice Chairman of the National Assembly Nguyen Khac Dinh suggested that the draft Law should more clearly demonstrate the State's viewpoint of encouraging and creating conditions for agencies, organizations, and individuals, including domestic and foreign agencies, enterprises, and private individuals, to invest in research and development of digital technology, construction of data centers, products, and services related to digital data, innovation, and application in the digital field.
Delegates also requested that the drafting agency continue to review the provisions of the draft Law and related legal provisions to avoid overlaps and conflicts, ensure consistency in the legal system, and have principled provisions that are in harmony with the draft Law on Personal Data Protection under development; clarify regulations on data collection and creation for individuals, etc.
Concluding the session, Vice Chairman of the National Assembly Tran Quang Phuong emphasized that the National Assembly Standing Committee basically agreed that the draft Law on Data is qualified to be reported to the National Assembly for approval at the 8th Session. In addition, to complete the draft Law to ensure quality, Vice Chairman of the National Assembly Tran Quang Phuong requested the drafting agency and the Standing Committee of the National Defense and Security Committee to note that the Law only regulates issues under the authority of the National Assembly, assigning the Government to specify in detail the contents under its authority; for new issues, the Law only regulates the framework and principles and assigns the Government to specify in detail to facilitate implementation and meet the requirements of both managing and unlocking Data resources; proposes to continue reviewing legislative techniques.
Vice Chairman of the National Assembly Tran Quang Phuong emphasized that the National Assembly Standing Committee requested the National Defense and Security Committee to coordinate with the Ministry of Public Security (the drafting agency) to continue perfecting the draft law, ensuring requirements and quality before submitting it to the National Assembly for consideration and approval at the 2nd Session, 8th Session, 15th National Assembly./.
