
The Law on Cultural Heritage promulgated in 2001, amended and supplemented with a number of articles in 2009, is a step to concretize the policy on cultural heritage conservation according to the 1992 Constitution and the spirit of the Resolution of the 5th Conference of the Party Central Committee (Term VIII).
According to Deputy Minister of Culture, Sports and Tourism Hoang Dao Cuong, since the Law came into effect, many policies and guidelines of the Party and State have continued to be issued to strengthen the orientation of cultural activities, including cultural heritage. Therefore, in carrying out the tasks assigned by the Prime Minister, since 2023, the Ministry of Culture, Sports and Tourism has actively coordinated with ministries, branches, socio-political organizations and localities to develop the Draft Law on Cultural Heritage (amended).

Given the urgency of the need for timely and appropriate adjustments and supplements to the Law on Cultural Heritage in line with the new situation, Director of the Department of Cultural Heritage Le Thi Thu Hien requested that delegates contribute their comments to the Draft Document of the Law on Cultural Heritage (amended) focusing on 6 groups of issues.
The focus is on: The system of concepts and processes for identifying, registering and ranking cultural heritage. Ownership and rights related to cultural heritage; rights, responsibilities and obligations of relevant parties in managing, protecting and promoting the value of cultural heritage. Mechanisms for mobilizing and attracting all social resources to actively participate in protecting and promoting the value of cultural heritage...

At the conference, many presentations clarified the necessary items to amend and supplement the Law on Cultural Heritage, such as: Including documentary heritage in the Law on Cultural Heritage (amended); supplementing regulations on the preservation of national relics, antiques and treasures; regulations on purchasing and bringing relics and antiques of Vietnamese origin from abroad to the country; policies for artisans in protecting intangible cultural heritage, etc.
In the section on museum activities and documentary heritage, many delegates said that it is necessary to perfect the legal framework and local policies for the management, protection and promotion of cultural heritage values in general and documentary heritage in particular.
To date, Vietnam has 7 documentary heritages recognized by UNESCO's Memory of the World Program, including 3 world documentary heritages and 4 Asia-Pacific documentary heritages. After 15 years of being a member country participating in the Program, domestically, documentary heritages still do not have a legal corridor to protect and promote their values. The proposal to include documentary heritages in the Law on Cultural Heritage (amended) this time aims to overcome the shortcomings when this type of heritage is not yet regulated in Vietnam's legal system.
The results of this conference and workshop are expected to further consolidate the theoretical, scientific and practical basis for the Ministry of Culture, Sports and Tourism to gradually perfect the regulations in each article and clause of the Draft Law on Cultural Heritage (amended) to be submitted to the National Assembly in the coming time.
