Clarifying specific mechanisms and policies to implement national target programs

Delegate Lo Thi Luyen, Deputy Head of the Provincial National Assembly Delegation, spoke at the group discussion session on the morning of January 16.

Participating in the speech, delegate Lo Thi Luyen, Deputy Head of the Provincial Delegation of National Assembly Deputies, assessed that the draft proposed 8 specific mechanisms and policies based on practice, at the request of localities and National Assembly Deputies. The proposed mechanisms and policies aim to remove difficulties and obstacles in the implementation process with the aim of speeding up the progress and improving the effectiveness of the programs, in order to improve and enhance the lives of people in disadvantaged areas.

Proposal to amend regulations related to authority

The draft resolution stipulates that the Provincial People's Council decides to allocate the annual central budget for regular expenditures of each national target program in detail to component projects. If necessary, the Provincial People's Council decides to delegate to the District People's Council to decide on detailed allocation to each component project.

Delegate Lo Thi Luyen asked, in which cases is it necessary, when is it necessary and when is it not necessary? "It is proposed to decentralize the decision to allocate details to each component project to the district People's Council because the adjustment of component projects is frequent, if waiting for the Provincial People's Council to meet, it will affect the progress of implementation and disbursement" - Deputy Head of the Provincial National Assembly Delegation expressed his opinion.

Regarding the order, procedures, criteria, and sample documents for selecting production development projects , the draft resolution stipulates that the provincial People's Committees decide. Delegates believe that this provision is necessary to facilitate localities to promptly complete the promulgation of local regulations according to decentralization, or amend and supplement regulations that have arisen problems to ensure the legal basis for implementing production development support activities, and speed up the disbursement of career capital for programs.

According to the draft resolution, in case the provincial People's Council has issued regulations on procedures, criteria, and sample documents for selecting production development projects under the National Target Programs, the provincial People's Committee can decide on amending and supplementing the regulations and report to the People's Council at the same level at the nearest session. "The issuance of new regulations by the provincial People's Committee will be more convenient and faster than issuing a decision to amend the resolution of the provincial People's Council. This is unprecedented and will cause confusion in the implementation process," affirmed delegate Lo Thi Luyen.

Regarding the pilot mechanism of decentralization to the district level in the management and implementation of national target programs, the draft resolution proposes 02 options: (1) The pilot implementation will be applied in the period of 2026-2030 with a maximum of 50% of district-level units in the area; (2) The pilot will be applied in the period of 2024-2025 with 01 district-level unit. Accordingly, the People's Council at the district level is allowed to adjust the plan for allocating public investment capital and regular expenses among national target programs in the medium-term public investment plan, annual public investment plan, and annual state budget estimates assigned by competent authorities; the structure of budget capital sources between investment expenditure and regular expenditure of component projects that are no longer eligible for support to focus capital on implementing other component projects under the national target programs in the period of 2021-2025.

The Deputy Head of the National Assembly Delegation of Dien Bien province proposed choosing option 2, piloting application in 01 district in the period of 2024-2025 to concretize the requirements of the National Assembly in Resolutions No. 100/2023/QH15, No. 108/2023/QH15 and serve as a basis for promulgating and implementing national target programs in the period of 2026-2030.

Clarifying the content of specific policies

The draft resolution stipulates that the state management agency is assigned to the owner of the production development project to purchase goods for production development activities. Delegate Lo Thi Luyen said that such a provision is appropriate, ensuring that project owners are encouraged to participate in cases where these goods have both budget support and project owner capital. However, the assignment of the owner of the production development project to purchase goods for production development activities according to the draft resolution needs to clarify the case where the state management agency is assigned to the owner of the production development project.

According to Circular 55/2023/TT-BTC, there are two cases: (1) The unit performing the procurement support activities shall conduct bidding in accordance with the provisions of the law on bidding; (2) Assign the project owner to self-procure. However, Circular 55/2023/TT-BTC does not stipulate criteria for applying either of the above two cases. "It is proposed to specify the criteria for assigning the project owner to self-procure, that is, based on the project owner's proposal (application), the state management agency decides to assign the production development project owner to self-procure goods for production development activities in the Decision approving the project and based on the Decision approving the production development support project, the production development support project management agency shall pay support money from the state budget to the production development project owner to self-procure goods. Such regulations provide a basis for agencies to implement conveniently" - Delegate Lo Thi Luyen suggested.

Regarding the purchase of plant and animal breeds, although Decree 38/2023/ND-CP stipulates “priority shall be given to the use of plant and animal breeds and other goods and services directly produced by people in the project implementation area…”, localities have not been able to implement this provision due to problems with breed standards and market price determination.

The Department of Animal Husbandry has issued a document requesting that the standards of livestock breeds must meet the requirements of the Law on Animal Husbandry and related documents. People in disadvantaged communes mainly raise livestock on a small scale, with indigenous breeds, which cannot meet the conditions prescribed by the Law on Animal Husbandry (must have a certificate of parentage, be certified as an advanced breed, be raised according to barn standards, feed standards, etc.).

In Dien Bien, there is no unit that is qualified to supply, so it has to contract with units from other areas, leading to the price of livestock breeds being 2 to 3 times higher than the breeds that people sell locally (raised normally) because they have to bear the transportation costs and the cost of raising them according to standards. Due to long distance transportation and not adapting to the climate, the livestock get sick. The press focuses on reflecting that the price of livestock is high, the livestock get sick, the people who receive support do not agree... causing conflicting opinions, bad public opinion, and concerns from the management agency. People request to buy local breeds that are native breeds, selected based on local knowledge, senses, and experience in raising animals in terms of height, weight, waist circumference, neck circumference, skin color, fur color... and are breeds that are suitable for the climate conditions so they grow and develop well.

“I propose to add the following content to the draft resolution: In case of purchasing plant and animal varieties directly produced by people in the project implementation area, those plant and animal varieties only need to meet the standards according to the technical and economic norms issued by the provincial level and confirmed by the People's Committee at the commune level” - Delegate Lo Thi Luyen expressed her opinion.

Regarding the valuation of plant and animal breeds, the draft resolution stipulates that “The financial agency at the same level or the People's Committee at the commune level is responsible for determining the market price of goods in cases of payment at market price”. Delegates proposed to stipulate in the direction of assigning the district level to establish a team to appraise and value animal breeds in the area as a basis for implementation.

"There must be specific regulations on breeding standards and price determination so that localities can prioritize the use of local breeds" - Deputy Head of the Provincial National Assembly Delegation affirmed.
