On December 14, at the 15th Session of the People's Council of Da Nang City, Term X, 2021-2026, Mr. Tran Tuan Loi, Chairman of the Da Nang Bar Association, said that currently, notary offices still allow the situation of depositing, waiting for signature and paying commission percentages to banks and services.

The Department of Justice of Da Nang City has made adjustments, but this situation still occurs, leading to unhealthy competition among notary offices.

The situation of consignment and waiting for consignment causes tax loss for the City budget. At the same time, criminals take advantage of this to commit fraud and appropriate assets through consignment and waiting services.

Mr. Luong Cong Tuan, a representative of the People's Council of Hai Chau District, also shares the same opinion. The current situation of consignment and waiting for signature at notary offices is very complicated. The consequence is a large loss of state revenue.

However, to date, no cases of this behavior have been handled. “This is distorting the real estate market in the area,” Mr. Tuan emphasized.

Mr. Tuan suggested that the Department of Justice must coordinate with the police and must have expertise to grasp. Because the deposited and pending documents are not kept at the notary office, when checking, it is impossible to determine the violation.

“There must be a solution to do this. We must act decisively so that the city’s real estate market is healthy and operates in its inherent order,” said Mr. Tuan.

Meanwhile, Mr. Huynh Ba Cu commented that currently, the city has 34 notary organizations, which is a lot. Therefore, the authorities need to check the notary practice conditions of these units to better inspect.

Need to handle it firmly

Regarding this issue, Ms. Tran Thi Kim Oanh, Director of the Department of Justice of Da Nang City, said that the city currently has 34 notary organizations operating. Of which, there are 3 notary offices and 31 notary offices.

The City People's Committee has directed the Department of Justice to implement many contents and measures such as coordinating with the Tax Department to inspect the collection of notary fees, notary remuneration and other costs for mortgage contracts, as well as declarations at notary organizations to prevent tax losses. The Department of Justice also actively inspects and examines in this field.

In addition, the Department of Justice also coordinated with the Department of Natural Resources and Environment, the Tax Department, and the City Police to advise and develop a proposal for the City People's Committee to issue Decision 2543 dated November 20 on the regulations on coordination and prevention of tax losses in business activities and real estate transfers in Da Nang city.

In 2023 alone, the Department inspected 5 notary organizations. Through the inspection, the Department reminded and corrected some activities of notary organizations, and issued 3 decisions on administrative sanctions.

In the coming time, the Department will strengthen State management in the field of notarization, increase inspection and examination work, and strictly handle violations.

At the same time, the Department of Justice has also coordinated with the investigation agency and requested notary organizations to provide additional information. In 2019 and 2020, some notary records were informed and checked. The Department transferred them to the investigation agency but in the end, the deposit and pending signatures have not been processed.

In the coming time, the Department will research and propose solutions to coordinate with relevant agencies to strengthen this work to partly ensure civil safety of organizations and individuals in the area.

Regarding this issue, Mr. Luong Nguyen Minh Triet, Chairman of the People's Council of Da Nang City, commented that the situation of consignment and waiting means buying for 10 dong but only declaring 2 dong. Both the seller and the buyer benefit, but the State suffers and loses tax revenue.

Recently, the City leaders have also received many petitions related to notary offices regarding this issue. Therefore, the Department of Justice is requested to coordinate with relevant units to strengthen inspection and examination.
