Must classify garbage right from home
On May 22, the Buoi Ward Lawyers Association (under the Tay Ho District Lawyers Association, Hanoi ) coordinated with Dong Thai Secondary School to organize a conference on "Propaganda and dissemination of the 2020 Environmental Protection Law, guiding the classification of household waste".
Speaking at the Conference, Ms. Phan Thi Thuy Nga - President of the Buoi Ward Lawyers Association said that Decree 45/2022/ND-CP regulating administrative sanctions for environmental violations, including additional regulations on sanctions for individuals and households that do not classify household waste, will officially take effect from January 1, 2025.

The Decree has many notable points. Learning about the regulations not only contributes to protecting the environment and building a green, clean, and beautiful capital, but also avoids violations that are easily subject to administrative penalties.
Ms. Nga said that the Law on Environmental Protection stipulates that owners of domestic solid waste sources must be responsible for classifying waste right at the source according to the principles: capable of being reused and recycled; food waste and other solid waste.
After being sorted, waste must be contained in packaging according to regulations and transferred to individuals and units with collection functions. If any household does not sort waste before handing it over to the transport unit, it must pay a service fee for the collection and treatment of household waste.

Regarding the penalty regulations, according to Clause 1, Article 26 of the above Decree, the act of not classifying domestic solid waste according to regulations; not using packaging to contain domestic waste according to regulations will be fined from 500,000 VND to 1,000,000 VND.
In addition, this Decree also stipulates that the act of collecting and disposing of waste in violation of environmental protection regulations will be punished as follows: A fine of VND 100,000 to VND 150,000 will be imposed for the act of throwing, disposing, or discarding cigarette butts, butts, or ashes in the wrong place in apartment buildings, commercial areas, service areas, or public places.
Fines from VND 150,000 to VND 250,000 for personal hygiene (urination, defecation) not in the right place in apartment buildings, commercial areas, service areas or public places; fines from VND 500,000 to VND 1,000,000 for throwing, dumping, or dumping waste or wastewater not in the right place in apartment buildings, commercial areas, service areas or public places.
Or, a fine of VND 1,000,000 to VND 2,000,000 can be imposed for the act of dumping, disposing of, or discarding waste on sidewalks, roads, or into urban wastewater drainage systems or surface drainage systems; improperly dumping wastewater on sidewalks, roads; and disposing of plastic waste generated from daily activities into ponds, lakes, canals, rivers, streams, and seas.

Ms. Nga added that the authority to handle violations will be exercised by the People's Committee at the commune level. In addition, police officers on duty also have the right to impose fines.
“It can be seen that the monitoring, detection and handling forces are very large. Therefore, just one act of littering on the sidewalk, throwing trash into the lake, or throwing cigarette butts in the wrong place, whether accidentally or intentionally, is very easy to be punished,” said Ms. Nga.

“I hope that teachers will integrate the content shared at the conference into appropriate lessons, especially class activities, so that students can grasp it. From there, students will implement it and disseminate it to their families. To build an elegant and civilized Hanoi, it is necessary to start with small actions to protect the environment right in your own home,” Ms. Nga expressed.
