If tuition fees are not refunded, Pedagogy students may be sued

According to the new regulations, if a student does not pay his/her training fees (tuition, living expenses), he/she can be sued in court.


This is one of the new points of Decree 60/2025 recently issued by the Government, amending and supplementing a number of articles of Decree 116/2020 on policies to support tuition fees and living expenses for Pedagogy students.

The new decree was issued in the context that after 3 years of implementation, Decree 116 has encountered some problems such as: localities committed to placing orders but did not implement them, leading to delayed payment of funds; regulations on bidding for teacher training have no specific instructions; difficulties and insufficient funds to support students. In addition, the training of Pedagogy students and the recruitment after graduation into the education sector are not synchronized, leading to difficulties and lack of strictness in reimbursement of funds.

From the above limitations, Decree 60 was issued to overcome the limitations and difficulties in the implementation of the old decree, while continuing to support and attract excellent and dedicated students to study and work, contributing to the education sector.

Accordingly, Decree 60/2025 stipulates more specifically the responsibilities of agencies and units in recovering training costs for Pedagogical students. Specifically, the People's Committee of the province where the student resides is responsible for issuing a notice to recover the support costs. Students will pay the refund to the training institution or the ordering agency to pay into the state budget.

Pedagogical students with a working capacity reduction of 61% or more or who die will have their compensation costs erased.

Decree 60 regulates the method of financial support for Pedagogy students, in which the State provides support in the form of budget allocation according to budget decentralization. If the locality has a need for teachers, it will assign the task of teacher training to its affiliated pedagogical school or place teacher training orders with universities across the country.

With this regulation, training facilities for pedagogical students and pedagogical students will be funded more promptly and adequately, contributing to creating conditions for pedagogical students to study with peace of mind and improving the quality of the teaching staff.

Decree 60 also clarifies the responsibilities of relevant parties such as the Ministry of Education and Training, the Ministry of Finance, provincial People's Committees, teacher training institutions, learners... in ensuring financial support for Pedagogy students.

The Decree clearly stipulates that the support budget is balanced in the annual State budget expenditure estimates according to the current management decentralization. The central budget supports local budgets to implement the policy according to the principle of targeted support. This regulation overcomes the situation where some localities cannot balance their budgets to support Pedagogy students, while ensuring implementation in accordance with the provisions of the 2019 Education Law.

The Decree takes effect from April 20 and applies starting from the 2025-2026 school year.

Decree 116 stipulates cases where Pedagogy students must reimburse tuition fees and living expenses, including:

  • Pedagogical students who have enjoyed the policy of not working in the education sector after 2 years from the date of graduation recognition decision;
  • Pedagogical students who have enjoyed policies and worked in the education sector but do not have enough working time as prescribed in Point a, Clause 2 of this Article;
  • Pedagogical students who are entitled to policies during their training period but transfer to another training major, voluntarily drop out of school, do not complete the training program or are disciplined and forced to drop out of school.
