The draft Law on Social Insurance (amended) was first commented on by the National Assembly at the 6th session (October 2023) and has just been submitted for comments at the Conference of specialized National Assembly deputies (March 27, 2024).
Today, the National Assembly will discuss many important contents of the Law on Social Insurance (amended).
Opening the second working week of the 7th Session (taking place from May 27-31), the 15th National Assembly, today (May 27) the National Assembly will discuss many important issues in the parliament.
According to the working program, the member of the National Assembly Standing Committee and Chairman of the National Assembly's Social Affairs Committee will present a report explaining, accepting and revising the draft Law on Social Insurance (amended). Next, the National Assembly will discuss in the hall a number of contents with different opinions of the draft Law on Social Insurance (amended); the submitting agency and the agency in charge of the review will coordinate to explain and clarify a number of issues raised by National Assembly deputies.

Previously, the current Law on Social Insurance was passed by the 13th National Assembly at the 8th session on November 20, 2014. After nearly 7 years of implementation (since the Law took effect on January 1, 2016), the Law has actively contributed to ensuring the legitimate and legal rights of employees and employers through short-term and long-term social insurance regimes.
However, the implementation of the 2014 Law on Social Insurance also revealed shortcomings, limitations and inadequacies such as: The coverage of participants and beneficiaries of Social Insurance in reality is still low compared to the potential; compliance with the law on Social Insurance is still low, the situation of late payment and evasion of Social Insurance payment still occurs in many localities and enterprises; the voluntary Social Insurance policy is not really attractive to people to participate; some regulations are no longer suitable to the current context and practical conditions; the rate of people receiving pensions, Social Insurance benefits and monthly social allowances only accounts for about 35% of the total number of people after retirement age; especially the rate of people receiving one-time Social Insurance benefits has increased rapidly in recent years...
In particular, when new situations arise, especially after COVID-19, many contents are no longer suitable. The National Assembly's decision to amend the Law is a practical and inevitable requirement.
After one year, from July 6, 2022, when the Prime Minister issued Decision No. 799/QD-TTg assigning the agency in charge of drafting, the draft Law on Social Insurance (amended) was submitted to the National Assembly with a set of documents including the draft Law and other documents that are relatively complete according to the provisions of the Law on Promulgation of current legal documents.
