Passports with less than 6 months validity are still allowed to exit from August 15, 2023
Specifically, Clause 11, Article 1 of the Law amending and supplementing a number of articles of the Law on Exit and Entry of Vietnamese Citizens and the Law on Entry, Exit, Transit and Residence of Foreigners in Vietnam 2023 amends Point a, Clause 1, Article 33 of the Law on Exit and Entry of Vietnamese Citizens 2019, requiring Vietnamese citizens to exit the country to have intact and valid exit and entry documents.
Currently, according to Point a, Clause 1, Article 33 of the 2019 Law on Exit and Entry of Vietnamese Citizens, Vietnamese citizens must have intact and valid exit and entry documents; passports must be valid for at least 6 months. |
Cases of temporary suspension of exit
Pursuant to Article 36 of the 2019 Law on Exit and Entry of Vietnamese Citizens, cases of temporary suspension of exit include:
- Suspect, defendant; denounced person, person proposed for prosecution, who through examination and verification has grounds to determine that person is suspected of committing a crime and it is deemed necessary to immediately prevent that person from escaping or destroying evidence according to the provisions of the Criminal Procedure Code.
- People whose prison sentences are postponed, people whose prison sentences are temporarily suspended, people who are conditionally released from prison early during the probation period, people who enjoy suspended sentences during the probation period, people who serve non-custodial reform sentences during the sentence period according to the provisions of the Law on Enforcement of Criminal Judgments.
- Persons with obligations under the provisions of the law on civil proceedings if there is a basis to show that the settlement of the case is related to their obligations to the State, agencies, organizations, individuals and their exit affects the settlement of the case, the interests of the State, the legitimate rights and interests of agencies, organizations, individuals or to ensure the execution of the judgment.
- The person subject to civil judgment enforcement, the legal representative of an agency or organization that is obliged to enforce a judgment or decision shall be subject to enforcement in accordance with the provisions of the law on civil judgment enforcement if there is evidence that their exit from the country affects the interests of the State, the legitimate rights and interests of the agency, organization or individual, or to ensure the enforcement of the judgment.
- Taxpayers, legal representatives of enterprises being forced to execute administrative decisions on tax management, Vietnamese people leaving the country to settle abroad, Vietnamese people residing abroad who have not fulfilled their tax payment obligations before leaving the country according to the provisions of the law on tax management.
- The person being enforced, the representative of the organization being enforced to execute the decision on administrative violation sanction and it is deemed necessary to immediately prevent that person from escaping.
- The person being inspected, examined, or verified has sufficient grounds to determine that he or she has committed an especially serious violation and it is deemed necessary to immediately prevent that person from escaping.
- People who are suffering from a dangerous, contagious disease and it is deemed necessary to immediately prevent the disease from spreading to the community, except in cases where the foreign country allows entry.
- People whose authorities have grounds to believe that their exit affects national defense and security.
