Ngoc Vy Resort Service Area Project, in Trung Trach Commune, Bo Trach District, was approved in principle by the People's Committee of Quang Binh Province in Decision No. 2599/QD-UBND dated August 8, 2018. Land area 3,011.8m2, land use purpose for commercial and service purposes.

At the end of October 2022, the People's Committee of Bo Trach district issued a decision to administratively fine the project owner VND 65 million, requiring him to complete the documents and obtain a construction permit within 90 days; after the deadline, he must demolish the project himself, otherwise he will be forced to do so.

On March 2, 2023, Bo Trach District People's Committee issued construction permit No. 301/GPXD to Mr. Phan Ngoc Hoa, with an area of ​​over 3,000m2, valid for 12 months.

The scale of investment in the resort meets 3-star standards.

During the implementation of the licensed project, the Investor submitted a written request to implement the Ngoc Vy Resort Service Area Expansion investment project in Trung Trach commune. The project was approved by the People's Committee of Quang Binh province in Decision No. 2721/QD-UBND dated August 25, 2021 with a land use area of ​​8,690m².

The scale of investment in the resort meets 3-star standards, the main investment items include: Resorts (expected 10): 3,000m², Swimming pool: 500m²; Parking lot, trees and other auxiliary items; total investment capital is 27 billion VND.

Regarding implementation progress, the project will start within 12 months from the date of the Decision approving the investment policy and simultaneously approving the investor; Complete and put the project into operation within 24 months from the date of commencement.

According to the reporter, up to now the project is still "inactive", the built items have been left unused for a long time, leading to deterioration and waste.

Problems with land allocation and lease procedures

On July 16, 2024, the Department of Planning and Investment (DPI) of Quang Binh province issued Document No. 1875 on post-investment supervision handling of this project.

According to the Department of Planning and Investment, the project has been behind schedule in starting construction and is about to be behind schedule in completing the project. The project has registered a land use plan, completed the deposit, approved the detailed planning and environmental protection plan, completed the statistics of land correction results, submitted documents for land allocation and land lease but has not been allocated or leased land.

The Department of Planning and Investment requested the People's Committee of Bo Trach district to direct specialized departments and offices to study and support investors in completing land allocation and land lease procedures so that investors have a basis to implement the next steps of the Project.

Due to problems in land allocation and leasing procedures, the project cannot continue.

In case of difficulties or problems, please provide specific comments so that investors can know and coordinate to handle them or report to the Provincial People's Committee to resolve problems beyond their authority.

At the same time, the investor is required to urgently work with the District People's Committee to carry out the above procedures. If after the prescribed time limit, the investor finds it capable of continuing the investment, the project schedule must be adjusted and a commitment must be made that this is the last proposal for schedule adjustment.

Bo Trach District People's Committee hopes that the investor will complete the items that have been granted construction permits.

Regarding the above issue, Mr. Bui Quoc Thanh, Vice Chairman of Bo Trach District People's Committee, said that for the land area that has been granted a construction permit, the district requested the investor to continue completing the unfinished construction items.

Regarding the expansion project, after comparing with current regulations, the application for land recovery, land allocation, and land lease to Mr. Phan Ngoc Hoa does not meet the conditions.

"Mr. Hoa's file still has many problems. The district's authority is asking departments and offices to review and ask Mr. Hoa to redo or supplement it. Only when the land procedures are completed can the license be issued," said Mr. Thanh.

"I am very sad to see the built items degraded and damaged. For the area that has a license, even if completed, it cannot be exploited and will also degrade. So I hope to complete all legal documents to invest in the whole thing and put it into operation soon," Mr. Phan Ngoc Hoa explained.

On the investor's side, Mr. Phan Ngoc Hoa said that the project, in addition to its business purposes and creating jobs for surrounding residents, also contributes to beautifying the homeland.

However, during the implementation process, the project encountered many difficulties. He himself hopes that relevant authorities will guide and support him to complete the application procedures and put it into operation soon.
