Since Circular 29 of the Ministry of Education and Training regulating extra teaching and learning officially took effect from February 14, the number of teachers registered for business in Ho Chi Minh City has increased day by day.
Easy registration
Early in the morning of February 21, Mr. Nguyen Huu Loc (Ward 1, Phu Nhuan District) went to the District Tax Department to declare taxes for his son-in-law's tutoring business (a junior high school teacher) to facilitate his tutoring of English at home.
Mr. Loc said that the business registration procedure is quite simple and quick. Previously, he completed the business registration procedure online, after 3 days he received a notice to go to the district to receive a business license. Today, he came to complete the tax-related procedures.

Mr. Loc said that when he completed the registration of his tutoring business, some teachers asked him to help them with the procedures to teach according to regulations , but he refused. "Currently, only my children are teaching under the business I registered. I have to research this carefully before making a decision," he said.
Ms. Vu Thi Hai Yen - Deputy Head of Phu Nhuan District Tax Department said that from February 14 to now, the unit has received nearly 20 cases of tax registration for tutoring businesses, the number of which increases every day. Among them are cases of relatives registering on behalf of them, freelance teachers and retired teachers.
"This is the first time that tutoring has to be registered as a business, so many people are still confused. Most people still have questions about the method of signing contracts between business owners and teachers. In addition, how will teachers who sign contracts with business households pay taxes? We are always ready to provide advice and resolve problems for people," said an officer at the Phu Nhuan District Tax Department.
Still have many concerns
According to some public school teachers in Ho Chi Minh City, previously, tutoring was rampant, and most teachers opened tutoring classes at home. When regulations were introduced that required tutoring businesses to be registered and public school teachers were not allowed to be business owners, spontaneous tutoring classes were forced to close.
Many public school teachers who wanted to teach extra classes gathered in groups, then asked the business owner to sign a contract with the teachers to legally teach extra classes.
“ It is unreasonable to allow anyone other than public teachers to be the owner of a tutoring business. Many people without professional teaching qualifications are allowed to own tutoring centers. Where will the quality of education go? Because who can guarantee the quality of teachers and facilities at those tutoring centers? In my opinion, we should either ban tutoring, or allow them to register to teach at schools under the management of the Department of Education and Training,” the leader of a secondary school in Binh Tan district suggested.
Many cases have successfully registered for business licenses but are still worried about the upcoming operation process. Specific regulations on facilities, teaching equipment, fire prevention and fighting... still have many questions that have not been clarified.
Ms. Minh Anh, a freelance English teacher, said that she used to teach online and tutor students at home. Since learning about the new regulations on extra teaching and learning, she has completed all the procedures. However, she has now temporarily suspended her students because she is not clear about the regulations on online teaching.
"I have also just built a new room dedicated to tutoring and purchased tables and chairs. After completing the registration procedures, I plan to expand the class size to 15 to 20 students, but it has not officially opened yet. I am still worried about whether there are any regulations I have not met," said Ms. Minh Anh.

After the new circular was issued, a Literature teacher in Thu Duc City sought out private tutoring centers to sign a contract. However, after learning that the tax rate was 20-25%, she was concerned because the tax rate was too high.
For now, this female teacher has temporarily stopped teaching at home. For senior students, she teaches online to groups of 5 students.
"These are students with below average academic performance, I also want to support them to gain more knowledge. They are currently in grade 9, this year they are taking their final exams, and this is the first year they are taking the exam under the new general education program, so they are very worried. Parents all call me for support and I also promise not to charge any fees," said this teacher.
Article 6, Circular 29 on additional teaching and learning of the Ministry of Education and Training stipulates that organizations or individuals organizing additional teaching and learning activities outside of school with fees from students (collectively referred to as additional teaching establishments) must comply with business registration requirements according to the provisions of law.
Circular 29 also stipulates that those who teach outside of school must ensure that they have good moral qualities and professional qualifications appropriate to the subjects they teach. Teachers who are teaching at schools and participate in extra-curricular teaching must report to the Principal about the subjects, locations, forms, and times of extra-curricular teaching.
