Do home tutors have to register their business and list their prices?

From February 14, according to Circular 29 of the Ministry of Education and Training, organizations and individuals organizing extra teaching activities will have to register their business.

The circular does not specify whether individuals organizing extra teaching activities include teachers currently teaching at schools.

If the concept of "individual" includes all subjects, home tutors must also register their business according to the law. At the same time, when registering their business, teachers must publicly post information related to their tutoring, including subjects, teaching duration, teaching time, fees, etc.

In addition, the Circular stipulates that teachers teaching at public schools are not allowed to participate in managing and operating extra teaching outside of school.

So if a teacher opens a class at home and takes care of everything from management, operation to teaching by himself, is he considered to be violating the regulations?

Many teachers said that these regulations left them with many concerns, unfamiliarity and confusion.

Ms. NTNH - a secondary school math teacher in Thai Binh - expressed: "The new regulation will minimize the negative effects of extra teaching and learning. But we teachers cannot help but feel confused.

We have never considered home tutoring as a business, but now we may have to consider it a business.

Previously, the collection of tuition fees from students was unclear. Some students were charged 50,000 VND, some were charged 30,000 VND, and some were not charged at all. Parents thanked the teacher depending on their family circumstances and conditions. Now, the collection of tuition fees may have to be listed as a "price" like any other business service.

In some ways, we, the retiring generation of teachers, feel sad.

But in reality, extracurricular education has long developed a business service sector. Therefore, I think the new regulation is consistent with real life. Teachers must get used to the new concept of tutoring."

Sharing the same view, Ms. NTH - a literature teacher in Quang Ninh - said that the new regulation will erase the boundary between tutoring for students and tutoring for a living, turning tutoring into a business activity.

"Many teachers in the countryside, old generation teachers still feel uncomfortable when parents ask how much tuition is to send their children to school. Usually when receiving the entrustment of parents, we teach the children with all our heart and responsibility.

Parents give and receive as much as they want without "setting a price". Whether they give a little or a lot, we all consider it as the parents' kindness.

This regulation makes teaching and learning activities outside of school "cleaner", but on the one hand, it can also change the teacher-student relationship," Ms. NTH is concerned.

Ms. NTH also expressed that she is not sure whether it is still legal for teachers to open extra classes at home according to the above regulations.

Which agency grants business registration license for home tutors?

According to lawyer Hoang Van Liem - Hoang Liem Law Office, home tutors can register their business at the district-level business registration agency, which is the Finance - Planning Department under the district-level People's Committee.

Ms. NMH - a chemistry teacher at a high school in Hai Duong - shared that most teachers are not familiar with administrative procedures. Having to register a business can be a psychological obstacle for them.

Therefore, she hopes to receive detailed and complete support and guidance from the school and the Department of Education and Training regarding this issue.
