On the morning of February 19, the National Assembly voted to pass a Resolution on piloting a number of mechanisms and policies to remove obstacles in science, technology, innovation and national digital transformation activities.
ESTABLISHING A BUSINESS FROM RESEARCH RESULTS
According to the resolution, public science and technology (S&T) organizations and public higher education institutions are allowed to establish or participate in establishing, and contribute capital to enterprises to commercialize the results of scientific research and technology development owned or assigned to manage and use by such organizations.
Managers working at public science and technology organizations and public universities are allowed to contribute capital, manage, operate, and work at enterprises established by such organizations or participate in establishing them to commercialize research results created by such organizations with the consent of the head of the organization.

In case the management officer is the head of a public science and technology organization or public university, he/she must have the consent of the direct superior.
Article 4 of the Resolution clearly stipulates "Accepting risks in scientific research and technological development" including:
Firstly : "Organizations and individuals engaged in scientific research and technological development activities are exempted from civil liability when causing damage to the State in the process of performing scientific and technological tasks using the State budget when they have fully implemented relevant procedures and regulations in the process of implementing scientific research and technological development activities".
Second : "The organization in charge of implementing a scientific and technological task using the state budget during the implementation process has fully implemented the regulations on scientific and technological task management, the research process and content have been explained but did not achieve the expected results, it does not have to refund the funds used."
EXPENDITURE IN RESEARCH
The State shall give priority to budgetary allocation for the implementation of science and technology tasks under the fund mechanism through science and technology funds. State science and technology development funds shall be established in accordance with the provisions of the Law on Science and Technology.
Funds from the state budget are annually allocated to implement science and technology tasks through science and technology development funds. The competent authority of the unit assigned to manage the fund is responsible for inspecting and supervising the activities of the fund management unit, ensuring the disbursement and use of the allocated budget on schedule and effectively.

Scientific and technological tasks are carried out according to the method of spending on final products when the organization in charge of implementing the scientific and technological tasks has a commitment to the product with the main quality criteria that need to be achieved.
The host organization is responsible for organizing the exploitation of assets formed from scientific and technological tasks using the state budget, continuing to invest in commercialization to ensure efficiency.
According to the resolution, income from salaries and wages from performing scientific and technological tasks using the state budget is not subject to personal income tax.
CHIP MANUFACTURING ENTERPRISES RECEIVE BUDGET SUPPORT
The Resolution clearly states that the central budget is used to invest, purchase, lease, maintain, operate, and maintain digital platforms and information systems at national and regional scales for central and local agencies and organizations to use and exploit together to serve socio-economic development, ensuring efficiency and avoiding waste.
Ministers and provincial People's Committee Chairmen are allowed to apply the form of bidding appointment according to the provisions of the law on bidding for bidding packages with contractor selection time in the period of 2025-2026 for tasks, projects, activities of hiring information technology services, digital transformation to deploy and build contents such as: National general database, national database, shared database of ministries, branches, localities; digital platforms, information systems at national and regional scale; information systems for handling administrative procedures at ministerial and provincial levels...
The state budget to support businesses in quickly deploying 5G network infrastructure nationwide is stipulated as follows: Telecommunications businesses must achieve at least 20,000 5G transmission stations that have been accepted and put into use from the effective date of this resolution until December 31.
The total amount of support for telecommunications enterprises shall not exceed the total winning bid amount of radio frequency usage rights auctions conducted in 2024.
The support level for a 5G broadcasting station is 15% of the average equipment cost for a station purchased in 2025 by supported telecommunications enterprises.
The resolution also clearly states the controlled pilot of telecommunications services using low-orbit satellite technology.
Specifically, piloting controlled investment in telecommunications services with network infrastructure, satellite telecommunications network type using low-orbit satellite technology in Vietnam on the principle of ensuring national defense and security, in which there is no limit on the percentage of shares owned, capital contribution or contribution ratio of foreign investors.
In addition, the resolution clearly stipulates support for Vietnamese enterprises to invest in building the first factory project selected to manufacture small-scale, high-tech chips to serve research, training, design, trial manufacturing, technology verification and production of specialized semiconductor chips in Vietnam.
The above enterprise will be supported with 30% of the total project investment directly from the central budget in case the factory is accepted and put into production before December 31, 2030. The total support amount will not exceed VND 10,000 billion.
During the preparation and implementation of the project, an annual deduction of more than 10% but not exceeding 20% of taxable income for the enterprise's science and technology development fund may be made to supplement the project. The total amount of deduction shall not exceed the total investment of the project.
Timely institutionalization of Resolution 57 into practice
According to the draft Resolution of the Government, the development of a Resolution on piloting a number of mechanisms and policies to remove obstacles in science, technology, innovation and national digital transformation activities aims to promptly institutionalize Resolution 57 into practice; promote decentralization, delegation of power, and simplify administrative procedures; ensure that science and technology, innovation and national digital transformation are breakthroughs and one of the most important driving forces for socio-economic development.
The Resolution consists of 17 articles, with the aim of piloting a number of specific mechanisms and policies to remove obstacles in science and technology activities, innovation and national digital transformation; policies must provide outstanding incentives to remove obstacles and help move big things forward; the spirit of innovation will help Vietnam successfully implement science and technology, innovation and digital transformation with advanced digital infrastructure development and the development of Vietnam's digital technology industry.
