On March 6, the Ministry of Justice coordinated with the Ho Chi Minh National Academy of Politics to organize a national scientific conference on “Innovation in law-making and enforcement to meet the requirements of national development in the new era”. The conference focused on analyzing urgent requirements in law-making and enforcement to meet the requirements of national development in the new era - the era of rising up and prosperity of the Vietnamese people.

Meeting the requirements of national development in the New Era

Highly appreciating the reports in the conference proceedings, along with the opinions, advice and policy proposals for the Party and Government in innovating the work of building and enforcing laws to meet the requirements of national development in the new era, Politburo member, Party Central Committee Secretary, Head of the Central Internal Affairs Commission Phan Dinh Trac said that this is a valuable source of reference for building and perfecting the Party's policies and orientations related to building and enforcing laws in the Draft Documents of the 14th National Congress of Delegates, and in the immediate future, building a strategic directive document of the Politburo on "Innovating the work of building and enforcing laws to meet the requirements of national development in the new era" in the coming time.

According to Head of the Central Internal Affairs Commission Phan Dinh Trac, in recent times, our Party and State have had many policies and guidelines to innovate and improve the effectiveness of law-making and law enforcement, achieving many important results. Our country has formed a relatively synchronous, public, transparent, and accessible legal system that basically regulates all areas of social life; creating a legal foundation for socio-economic development, ensuring national defense, security, and international integration of the country.

However, the work of building and enforcing laws still has many limitations and shortcomings. Some major policies and orientations of the Party have not been institutionalized promptly and fully. The quality of laws has not kept up with practical requirements. The organization of law enforcement is still a weak link. That context, together with the requirements of national development in the new era, is posing an urgent need to innovate the work of building and enforcing laws, contributing to creating a strong driving force for rapid and sustainable development of the country.

With more than 70 papers sent to the Conference Organizing Committee and more than 50 papers selected for publication in the conference proceedings, the scientific reports presented at the Conference and the discussion opinions of the delegates continued to clarify the orientations and solutions for innovation in law-making and enforcement to meet the requirements of national development in the new era.

Removing the “bottleneck of the bottleneck”

Head of the Central Internal Affairs Commission Phan Dinh Trac emphasized the following major points of high consensus: First of all, for the country to enter a new era, an era of national growth, in order to contribute to the successful implementation of the goal of Vietnam becoming a developing country with modern industry and high average income by 2030, and a developed country with high income by 2045, innovation in the work of building and enforcing laws to serve national development has never been as urgent as it is today. We need to successfully build high-quality institutions, internationally competitive institutions, attract talent, liberate resources, and take advantage of development opportunities with the motto of harmonizing benefits and sharing risks.

In February, the National Assembly promulgated the Law on Promulgation of Legal Documents (amended) with many fundamentally innovative contents. This is a very important tool to innovate the current law-making work, thereby creating a premise to improve the effectiveness of law enforcement organization. However, process innovation is a very important factor but not enough to thoroughly resolve the institutional situation that is considered the "bottleneck of bottlenecks". To overcome this limitation, comprehensive innovation in law-making and enforcement, focusing on innovation in thinking, with a superior investment mechanism in human resources, infrastructure and finance for law-making and enforcement is necessary.

At the same time, ensure direct and comprehensive leadership, highly promote the Party's spirit in building and enforcing the law. In particular, unanimously identify the leadership in institutionalizing the Party's policies and guidelines into laws and leading the work of enforcing the law to ensure the supremacy of the Constitution and the law as the central and regular task of Party committees and organizations at all levels. Strengthen inspection and supervision of the work of institutionalizing the Party's policies and guidelines into laws. Strictly implement regulations on controlling power, preventing and combating corruption, negativity, and "group interests" in the work of building and enforcing the law.

Fundamental innovation in law-making thinking

The thinking of law-making that advisory agencies and each policy and law-making staff need to be equipped with to suit the requirements of national development in the new era must be the thinking of creating development, taking advantage of all development opportunities of the country, opening up and strongly mobilizing all social resources for the breakthrough development of the country, for the happiness of the people.

Therefore, it is necessary to innovate the thinking of law-making in the direction of "both strict management and development creation", resolutely abandoning the thinking of "not knowing but still managing", "not being able to manage, then banning", "people and businesses are allowed to do what the law does not prohibit"; promoting the method of "management by results", strongly shifting from "pre-control" to "post-control" associated with strengthening inspection and supervision. Properly promote the role of social ethics, professional ethics, and community self-management rules in regulating social relations.

In the coming time, it is necessary to organize and effectively implement the Law on Promulgation of Legal Documents (amended). In particular, it is necessary to focus on policy research, impact assessment, and improving the quality of appraisal and examination of legal documents. It is necessary to promptly study and propose the National Assembly to issue a Resolution on a specific mechanism to remove difficulties and obstacles in the work of law making.

Ministries and sectors within their scope and management areas need to continue to proactively and urgently review legal documents, clearly identify inconsistencies, contradictions, and points that are no longer suitable to reality in order to propose amendments. Prioritize the construction and completion of legal corridors to clear bottlenecks for economic development to meet the requirements of national development in the new era. Quickly build legal corridors for new, non-traditional issues to form new growth drivers, new production relations and productive forces, and new industries. Reasonable application of controlled testing mechanisms. Continue to improve laws on the organization and operation of institutions in the political system to meet the requirements of building a socialist rule-of-law state of Vietnam in the new period, ensuring "streamlining, compactness, strength, efficiency, effectiveness, and efficiency".

Promote the spirit of serving the people

According to the Head of the Central Internal Affairs Commission Phan Dinh Trac, the innovation of thinking in law enforcement work is towards promoting the spirit of serving the people, the thinking of creating development, and acting for the common good among cadres, civil servants, and law enforcement agencies. Priority is given to ensuring effective law enforcement, first of all in the areas of promoting economic development (especially improving the investment and business environment, protecting the freedom of business, freedom of competition, start-ups, and innovation), and areas directly related to people's lives such as ensuring food safety, protecting the environment, ensuring security and safety in cyberspace.

Linking law making and enforcement, in which, promoting the summary of law enforcement practices, regularly evaluating the effectiveness of law enforcement, and the quality of policies after promulgation to speed up policy response, promptly remove difficulties and obstacles, amend and adjust inappropriate and contradictory regulations to take advantage of all development opportunities, minimize loss and waste of resources.

Along with that, create a breakthrough in law enforcement, focus on building a culture of law compliance, integrity, no corruption, waste, negativity, first of all among cadres, party members and agencies, organizations in the political system, spreading strongly in society; strongly promote the development of the legal service system, legal aid, legal support, arbitration, mediation, improve the quality of the national legal database so that people and businesses can easily access the law and manage legal risks.

Regularly evaluate the effectiveness of laws after promulgation; proactively detect and promptly remove "bottlenecks" caused by legal regulations. Strengthen dialogue, receive and listen to opinions, promptly resolve difficulties and legal problems of people and businesses, strengthen trust and social consensus in law enforcement. Promote the work of preventing and warning about violations of the law along with strengthening supervision, inspection, examination, detection and strict and timely handling of violations of the law.

In addition, it is necessary to urgently remove difficulties and obstacles in human resources, infrastructure, and finance for law-making work. Thoroughly grasp the viewpoint that investment in law-making is investment for development. The State ensures and prioritizes resources to invest in facilities, modernize technical infrastructure, and working equipment; has financial mechanisms and specific policies for the work and cadres doing legal work and law-making.

Proactively apply artificial intelligence, urgently build national digital platforms, develop databases, ensure unified, interconnected operations, exploit data and effectively support the work of building and enforcing laws. Restructure and complete the National Database on Laws to ensure unified, "correct, sufficient, clean, alive" operations, interconnection and support effective exploitation to serve the work of building and enforcing laws.

In particular, many comments also said that in the new context and situation, with recent strategic directions from the Central Executive Committee, the Politburo, the Secretariat, the General Secretary and other Party and State leaders, the work of law making and enforcement must be innovated comprehensively, systematically and with the nature of "breakthrough of breakthroughs".

Along with that, the entire political system is vigorously implementing the revolution of streamlining the organizational apparatus, aiming at the goal of streamlining - strengthening - efficiency - effectiveness - efficiency, promoting decentralization and delegation of power in the spirit of "Local decision, local action, local responsibility, the Central, Government, and National Assembly play a constructive role" and "strengthening supervision, inspection, urging, and removing difficulties and obstacles".

Conclusion 126-KL/TW dated February 14, 2025 of the Politburo and the Secretariat on a number of contents and tasks to continue to arrange and streamline the apparatus of the political system in 2025; Conclusion 127-KL/TW dated February 28, 2025 of the Politburo and the Secretariat on implementing research and proposing to continue to arrange the apparatus of the political system clearly states the direction of research to amend and supplement a number of articles of the Constitution within the scope of issues related to the apparatus of the political system.

In such a context and situation, the country is facing the need for strong, strategic and revolutionary policies and decisions on building and perfecting institutions, especially building and enforcing laws to create new momentum to bring the country to breakthrough development in the new era - the era of striving for strong, prosperous development of the nation.

Therefore, if we only stop at the level of researching and developing the Politburo's Directive on "Innovation in law-making and enforcement to meet the requirements of national development in the new era", it will be difficult to convey all the breakthrough orientations and solutions to strongly innovate this work. Therefore, it is necessary to propose to the competent authority to convert this task into researching and developing the Politburo's Resolution on "Innovation in law-making and enforcement to meet the requirements of national development in the new era".

Head of the Central Internal Affairs Commission Phan Dinh Trac also requested the Ministry of Justice to continue to closely coordinate with the Ho Chi Minh National Academy of Politics to research and fully absorb the enthusiastic and intellectual opinions of delegates, experts and scientists, promptly complete and send the results of the Workshop to competent authorities for reference in the work of advising, planning the Party's guidelines and policies, and building and enforcing laws.

"In addition, the agencies of the National Assembly, departments, ministries and branches continue to closely coordinate with the Ministry of Justice in the work of building and perfecting the legal system, while strengthening supervision of the organization of the implementation of the Constitution and laws," emphasized Phan Dinh Trac, Head of the Central Internal Affairs Commission.

 

Building and enforcing laws in the new era requires open thinking, new approaches, and is suitable for Vietnam's reality" and this requires dedicated experts and scientists to contribute ideas. We prioritize economic development, but take people as the main subject, so if we only focus on development, it will not be sustainable.

Recently, the Prime Minister has had many contacts with foreign enterprises, and enterprises also have concerns when we change the law. However, we must have an assessment and judgment that this change is to meet the requirements of streamlining the apparatus. Although the law has changed, it is necessary to clearly declare to investors that Vietnam's commitments to other countries have not changed. The change of law also does not increase costs for enterprises, and even reduces procedures according to the request of the General Secretary and the Prime Minister to cut administrative procedures. We change the law for stability and development.
