In the draft Circular on regulations for junior high school and high school admissions, the Ministry of Education and Training solicits opinions on subjects eligible for direct admission and preferential points in admission to grade 10.
In which, group 1 (with 2 priority points) has the following subjects: "Children of revolutionary activists before January 1, 1945; children of revolutionary activists from January 1, 1945 to the August 1945 Uprising".
Mr. Nguyen Xuan Khang, Chairman of the Board of Marie Curie School (Hanoi) said: "Only revolutionary elders aged 95 and older can be in this category. They cannot have children (aged 15) taking the 10th grade entrance exam from 2025 onwards. Therefore, the above regulations should be removed to suit reality."
According to Lawyer Dang Van Cuong, Hanoi Chinh Phap Law Office, in theory, this regulation is consistent with the policy for people with meritorious services, with the constitution and is humane. However, in reality, its feasibility is not high. The reason is that those who have been active before the August Revolution are now all over 100 years old, and the case of having children in grade 10 is very rare. If this regulation had been issued 40-50 years ago, it would have been more appropriate and feasible.
“In addition to being consistent with State policies and the Constitution, legal documents must also ensure feasibility. If feasibility is not high and cannot be applied in practice, it will become wasteful and unnecessary. Therefore, the Ministry of Education and Training should review and remove this regulation,” said Lawyer Dang Van Cuong.
According to Lawyer Dang Van Cuong, in order to not miss out on meritorious people, through data from the Department of Labor, War Invalids and Social Affairs, it is necessary to compile and review how many veteran revolutionary cadres are still in the country. On that basis, more appropriate, humane and feasible support policies should be proposed for this group of people.
A representative of the Department of Education and Training said that those who participated in the revolution before 1945 are now over 90 years old, and the rate of having biological children taking the 10th grade exam is very rare. However, there are also some cases where legally adopted children will still be given priority under this regulation.
Talking to VOV about this content, a representative of the Ministry of Education and Training said that the regulations need to cover all subjects and cases. This regulation includes both biological and legally adopted children of revolutionary activists.
“Based on Decree 131/2021 of the Government detailing and implementing the Ordinance on preferential treatment for people with revolutionary contributions, there may be situations where people participating in revolutionary activities from 15 years old but only adopt children when they are 70 - 80 years old, or even older.
We have carefully calculated during the drafting process and believe that there is still a possibility that it should be included so as not to miss out those who deserve preferential treatment, in order to ensure their rights," he said.
The representative of the Ministry of Education and Training also said that the regulations in the draft are just repeating the regulations already in the current Circular No. 11/2014/TT-BGDDT dated April 18, 2014 on the regulations for junior high school and high school admissions of the Ministry of Education and Training, which stipulates that the subjects who are given priority points include: Group 1: children of martyrs; children of war invalids with a labor capacity loss of 81% or more; children of sick soldiers with a labor capacity loss of 81% or more; children of people who are granted "a certificate of beneficiaries of policies like war invalids, and the person granted a certificate of beneficiaries of policies like war invalids has a labor capacity loss of 81% or more".
Group 2: children of armed forces heroes, children of labor heroes, children of heroic Vietnamese mothers; children of war invalids with less than 81% loss of working capacity; children of sick soldiers with less than 81% loss of working capacity; children of people granted "certificate of beneficiaries of policies for war invalids, where the person granted the certificate of beneficiaries of policies for war invalids has a reduced working capacity of less than 81%.
