Concerns about capital usage capacity, especially at district level
Continuing the working program of the 5th Extraordinary Session, on the afternoon of January 16, at the National Assembly House, the National Assembly discussed the "draft Resolution on a number of specific mechanisms and policies to implement national target programs".
Speaking at the discussion session, National Assembly Deputy Nguyen Anh Tri (Hanoi delegation) highly appreciated the Government for proposing and preparing a Resolution on a number of specific mechanisms and policies to implement national target programs and the National Assembly was extremely responsible in promptly bringing the content of discussion and voting on this Resolution to the 5th Extraordinary Session.
It is emphasized that this is a very necessary Resolution to specify the tasks assigned by the National Assembly to the Government in Resolutions No. 100 and No. 108 of the 15th National Assembly, which proposed specific policy solutions beyond the Government's authority to remove as many difficulties and obstacles as possible to speed up the implementation of national target programs.
Delegate Nguyen Anh Tri also stated that the process of preparing the draft Resolution dossier was very serious, careful, and in accordance with regulations, including the construction of the draft Resolution dossier, collecting opinions from localities to complete the dossier, and appraising the dossier to submit to the Standing Committee of the National Assembly on schedule. At the same time, continuing to review, absorb, and complete according to the shortened process to submit to the National Assembly for consideration today.
Regarding the mechanism for allocating and assigning the annual central budget for regular expenditures, delegate Nguyen Anh Tri found that the provisions in the draft Resolution are very open regarding capital allocation. However, the delegate still had concerns about the capacity to use capital, especially at the district level, to implement the program's sub-projects.

Regarding the name of the Resolution, delegates expressed their agreement with the name "Resolution of the National Assembly on a number of specific mechanisms and policies to implement national target programs".
Delegates proposed that the National Assembly, the Government, and the Program Management Board arrange funding from national target programs, especially from the national target program on sustainable poverty reduction, to support children under 6 years old from poor households to attend kindergarten.
“The reason why many children of poor families are the children of farmers and workers is that their jobs are unstable, and they cannot even find hired work, so their income is very low and they do not have a stable income,” said delegate Anh Tri, adding that because their families are so poor, the children cannot study in qualified childcare facilities, and may “go hungry, sleep cold,” and even be treated harshly.
According to delegate Anh Tri, national target programs often have quite clear content and capital has been allocated appropriately.
“However, I think there is no better way to raise children than to raise people, and there is no better way to grow trees than to grow people,” Mr. Tri said, suggesting that attention be paid to reallocating funds from the above national target programs to have funds for students in difficult circumstances to attend kindergarten, with the amount of support depending on the locality and the national target programs.
Clearly define budget allocation principles
Participating in giving opinions, delegate Mai Van Hai (Thanh Hoa delegation) contributed opinions on the allocation of the annual central budget's regular expenditure estimates. Delegate Mai Van Hai expressed agreement with the special mechanism for implementing the regular expenditure estimates.
In fact, when the Government assigns regular expenditure estimates to implement national target programs according to component projects, the sector will ensure that expenditures are controlled for the right purposes according to the set goals.

But besides that, Mr. Hai said that there are also difficulties and problems arising such as cases of spending on the wrong subjects, spending content is no longer suitable to local reality leading to low disbursement results of budget capital, especially career capital of national target programs...
To overcome the above problem, Mr. Hai said that the Prime Minister assigned the annual central budget regular expenditure estimate according to the total regular expenditure for each national target program and assigned the local People's Council to allocate details to each component project, which is completely appropriate, helping localities to be more proactive and allocate closer to the practical implementation of the contents of national target programs.
He proposed that at point c, clause 1, it should be clarified when it is necessary for the Provincial People's Council to delegate to the District People's Council the detailed allocation to each component project.
According to Mr. Hai, it is necessary to consider assigning the provincial People's Council to allocate to districts, towns and cities the total regular expenditure budget and assigning the district People's Council to allocate in detail to each component project. This will help districts to be proactive and use regular expenditure in a practical and effective manner.
At the same time, it is recommended that there should be clear regulations on criteria and principles of allocation so that localities can ensure proper purposes and effectiveness, and well implement the objectives of the national target program, avoiding subjective allocation, focusing on a number of specific projects.
Be more proactive in designing specific mechanisms
Speaking at the meeting, National Assembly Deputy Hoang Van Cuong (Hanoi delegation) said that since the beginning of the term, the National Assembly has regularly passed Resolutions on special mechanisms.
These special mechanisms often allow the enforcement entities to take actions that are different from the current legal regulations, to skip some unnecessary steps, to skip some unsuitable regulations to speed up the work progress. The use of special mechanisms always brings good results, no special mechanism has ever had a negative impact.
Mr. Cuong said that establishing specific mechanisms will help overcome the rigidity of legal regulations, making implementation plans more suitable to actual conditions and circumstances, thereby bringing good results.
According to Mr. Cuong, the law may be suitable in one field, but not really suitable in another field, other specific circumstances. Therefore, when the law is issued targeting a specific group of subjects, it may lead to inappropriateness when applied to other issues, other fields, other circumstances.
In the context of rapid development today, many new relationships and new problems will arise. Therefore, in the future, there will be many legal shortcomings that need to be overcome by special mechanisms. Therefore, Mr. Cuong believes that we should not wait for localities, sectors and fields to see problems and then propose special mechanisms, but should proactively propose mechanisms and methods to overcome and remove legal problems by special mechanisms .
