(TN&MT) – With the 8th Session of the 15th National Assembly having a large volume of legislative content, the National Assembly Chairman proposed to innovate thinking in law-making work to continue to thoroughly grasp and seriously implement the Party's policies and the General Secretary's instructions, in order to further improve the quality and speed up the progress of building and promulgating laws and resolutions of the National Assembly.
National Assembly Chairman Tran Thanh Man has just issued Official Dispatch No. 15/CTQH dated October 29, 2024 on innovation in thinking in law-making. Accordingly, the Official Dispatch clearly stated that Resolution No. 27-NQ/TW of the 6th Conference of the 13th Party Central Committee determined that one of the important goals and solutions to continue building and perfecting the socialist rule-of-law state of Vietnam in the new period is to build a legal system that is democratic, fair, humane, complete, timely, synchronous, unified, public, transparent, stable, feasible, accessible, opening space for innovation, creativity, and sustainable development . At the same time, the Law on Promulgation of Legal Normative Documents stipulates the principles in the development and promulgation of legal normative documents must ensure feasibility, economy, efficiency, timeliness, accessibility, and ease of implementation; ensuring the requirements of administrative reform.
On October 21, 2024, at the opening session of the 8th Session of the 15th National Assembly, General Secretary To Lam gave an important speech, in which he requested to continue to strongly innovate legislative work; transform the thinking of law-making towards both ensuring state management requirements and encouraging creativity, liberating all productive forces, and unleashing all resources for development; management thinking is not rigid, resolutely abandoning the thinking of "if you can't manage, then ban".
The provisions of the law must be stable and have long-term value; the law only regulates framework issues and issues of principle, and does not need to be too lengthy. Promote decentralization, delegation of power, and thoroughly reform administrative procedures. Focus on controlling power in law-making; tighten discipline, promote responsibility, especially the responsibility of leaders; resolutely fight against negativity and group interests. Proactively, positively, and urgently build a legal corridor for new issues and new trends, creating a legal framework to successfully implement the digital transformation revolution, creating a breakthrough for the country's development in the following years.
Innovation in thinking in law making
With the 8th Session, the 15th National Assembly has a large volume of legislative work. It is expected that the National Assembly will consider 32 draft laws and resolutions, of which it will strive to pass 15 to 18 laws, 04 legal resolutions and give opinions on the remaining draft laws. In order to continue to thoroughly grasp and seriously implement the Party's policies and the General Secretary's instructions to further improve the quality and speed up the progress of building and promulgating laws and resolutions of the National Assembly, the National Assembly Chairman requests:
Agencies and units assigned with the responsibility of drafting, submitting, reviewing, receiving and revising draft laws and draft resolutions, National Assembly deputies and staff and civil servants working on law-making shall organize research, study and thoroughly grasp the spirit of innovative thinking in law-making work according to Resolution No. 27-NQ/TW and the direction of the General Secretary; focus on leading and directing the work of drafting, reviewing, receiving and perfecting draft laws and draft resolutions submitted to the National Assembly for consideration and approval to ensure the following requirements:
Develop and promulgate concise laws and resolutions, stipulating contents within the authority of the National Assembly, closely following reality, not being perfectionist, not being hasty; absolutely not legalizing the provisions of decrees and circulars; eliminating from the draft law issues under the authority of the Government, ministries and other agencies. The provisions of the law must be clear, substantive, not general, not copying the contents already stipulated in other laws, contributing to simplifying and condensing the content of the law, ensuring ease of understanding and implementation.
For new issues that are in the process of being developed, and whose practices are constantly changing and unstable, only framework regulations are provided, which are principles and assigned to the Government, Ministries and local authorities to ensure flexibility in management and suitability to practice.
Strengthen decentralization and delegation of power, clearly defining the tasks and powers of agencies, organizations and individuals in the state apparatus, and improving implementation capacity. For tasks that ministries, branches and localities perform better, boldly decentralize and delegate power to ministries, branches and localities so that the Government and central agencies can focus on making policies and handling macro issues.
Thoroughly cut down and simplify administrative procedures, investment and production conditions, reduce compliance costs, and create the greatest convenience for people and businesses. Basically, the law does not stipulate the contents of administrative procedures, procedures, and documents, but assigns the Government and Ministries to regulate according to their authority to flexibly and promptly amend and supplement when necessary, creating favorable conditions for decentralization in accordance with reality and meeting the requirements of administrative reform.
Tighten discipline and order, promote the responsibility of the presiding agency in each stage of the process, promptly detect and strictly handle all acts of corruption, negativity, "planting" group interests, local interests in draft laws and resolutions of the National Assembly in accordance with Regulation No. 178-QD/TW dated June 27, 2024 of the Politburo on controlling power, preventing and combating corruption and negativity in law-making work.
National Assembly deputies promote democracy and intelligence to improve the quality of National Assembly activities.
The dispatch requested National Assembly deputies to promote democracy, intelligence, and the central role in innovation, improving the quality of the National Assembly's activities, with a professional, scientific, and thorough spirit but not perfectionism; closely following the requirements of reality, taking people and businesses as the center and subject, focusing on research, participating in contributing opinions to draft laws and resolutions to effectively remove obstacles and shortcomings, especially "bottlenecks" that hinder development, ensuring that the laws and resolutions passed by the National Assembly are of high quality, creating a favorable and synchronous legal corridor to promote the successful implementation of socio-economic development tasks in the period of 2021 - 2025 and the following years, bringing our country to continue to develop rapidly and sustainably in the new era, the era of the Vietnamese people's rise.
Agree on solutions to major, important issues
The Vice Chairmen of the National Assembly shall strengthen the supervision and implementation of the law-making work in the assigned areas; focus on directing the work of examining, receiving and revising draft laws and resolutions, first of all, the projects submitted to the National Assembly for approval at the 8th Session, ensuring the spirit of innovative thinking and improving the quality of legislative work in accordance with the spirit of Resolution No. 27-NQ/TW and the direction of the General Secretary; if necessary, directly chair the work with representatives of the Government's leadership, examining agencies, drafting agencies and relevant agencies to agree on solutions to handle major and important issues with different opinions, report to the Chairman of the National Assembly, seek opinions from the National Assembly Party Delegation, the National Assembly Standing Committee, propose reports to seek opinions from competent authorities on issues of policies and guidelines, ensuring the Party's comprehensive leadership over the law-making work.
Synchronously implement tasks and solutions in law-making work
The dispatch requested the Nationalities Council and the National Assembly Committees to thoroughly grasp and immediately implement innovative solutions in the process of examining, receiving and revising the projects assigned to chair at the 8th Session; focusing on: Closely coordinating with the drafting agency and relevant agencies to organize research, receive and fully and thoroughly explain the opinions of National Assembly deputies, perfecting draft laws and resolutions submitted to the National Assembly for approval to ensure the quality, feasibility, consistency and unity of the legal system; Well performing the work of examining projects submitted to the National Assembly for initial comments, clearly expressing viewpoints and opinions not only on issues within the project content but also on contents related to new approaches and thinking in law-making in accordance with the direction of the Party and State leaders.
The agencies drafting and submitting draft laws and resolutions shall synchronously carry out tasks and solutions on innovation in thinking in law-making, specifically: Closely coordinate with the agencies of the National Assembly in the process of receiving, revising and perfecting draft documents submitted to the National Assembly for consideration and approval; promptly seek the Government's opinions on issues with different opinions from the examining agencies to report to the National Assembly Standing Committee for consideration and unanimous handling before submitting to the National Assembly; Thoroughly grasp and closely follow the requirements of innovation to implement well right from the stage of drafting, appraising and submitting projects under the law and ordinance-making program for 2025 and the following years; Timely advise on preparation and submit to the Government for full and timely promulgation of detailed regulations meeting the requirements of innovation to soon put the laws and resolutions passed by the National Assembly into practice.
The National Assembly Chairman requested comrades, National Assembly deputies, and relevant agencies, according to their assigned functions and tasks, to promptly direct and organize effective implementation./
