Government "finalizes" increase in pensions and regional minimum wages from July 1

Increase at least 15% in pensions, social insurance benefits and monthly allowances

The Government has issued Decree 75 adjusting pension levels, social insurance benefits and monthly allowances for beneficiaries of pensions, social insurance benefits and monthly allowances before July 1, 2024.

Specifically, cadres, civil servants, workers, public employees and laborers; soldiers, people's police and people doing key work who are receiving monthly pensions;

Commune, ward and town officials; people receiving monthly allowances for loss of working capacity according to the provisions of law; people receiving monthly allowances; Commune, ward and town officials receiving monthly allowances;

Military personnel receiving monthly allowances, People's Public Security personnel receiving monthly allowances; Military personnel, People's Public Security personnel, and people working in key positions receive salaries as military personnel and People's Public Security personnel receiving monthly allowances;

People receiving monthly occupational accident and disease benefits; people receiving monthly death benefits before January 1, 1995...

The Decree clearly states that from July 1, the pension, social insurance allowance and monthly allowance of June 2024 will be adjusted up by 15% for the above subjects.

From July 1, people who are receiving pensions, social insurance benefits, and monthly allowances as prescribed in Clause 2 above, after an increase of 15% on the pension, social insurance benefits, and monthly allowances of June 2024, with a benefit level lower than VND 3.5 million/month, will be adjusted to increase.

Specifically, increase by 300 thousand VND/person/month for those with a benefit level below 3.2 million VND/person/month; increase to 3.5 million VND/person/month for those with a benefit level from 3.2 million VND/person/month to under 3.5 million VND/person/month.

The adjusted pension, social insurance allowance, and monthly allowance are the basis for calculating the adjustments to pension, social insurance allowance, and monthly allowance in subsequent adjustments.

Regional minimum wage increase from 200,000 to 280,000 VND

The Government has also issued Decree 74 regulating both monthly minimum wages and hourly minimum wages. The minimum wage is the lowest wage, the basis for employers to negotiate and pay wages to employees.

The subjects eligible for salary increase include employees working under labor contracts.

Employers under the provisions of the Labor Code are enterprises, agencies, organizations, cooperatives, households, and individuals that hire and use employees to work under agreements.

Thus, the regional minimum wage increases from 200-280 thousand VND compared to the current one as follows.

Region 1: 4.96 million VND/month (minimum hourly salary 23.8 thousand VND/hour)

Region 2: 4.41 million VND/month (minimum hourly salary 21.2 thousand VND/hour)

Region 3: 3.86 million VND/month (minimum hourly salary 18.6 million VND/hour)

Region 4: 3.45 million VND/month (minimum hourly salary 16.6 million VND/hour)

For employees who are paid weekly, daily, piecework, or piecework, the converted monthly or hourly salary must not be lower than the minimum monthly wage or minimum hourly wage.

Officially increase basic salary to 2.34 million VND/month from July 1, 2024

The Government issued Decree 73/2024 regulating basic salary and bonus regime for cadres, civil servants, public employees and armed forces.

Accordingly, from July 1, 2024, the basic salary will be 2.34 million VND/month instead of the current 1.8 million VND/month.

According to the decree, there are 10 subjects applying the basic salary including:

Cadres and civil servants from central to district level are specified in Clause 1 and Clause 2, Article 4 of the Law on Cadres and Civil Servants 2008 (amended and supplemented in the Law amending and supplementing a number of articles of the Law on Cadres and Civil Servants and the Law on Public Employees 2019).

Commune-level cadres and civil servants are specified in Clause 3, Article 4 of the 2008 Law on Cadres and Civil Servants (amended and supplemented in the Law amending and supplementing a number of articles of the Law on Cadres and Civil Servants and the Law on Public Employees in 2019).

Civil servants in public service units as prescribed in the Law on Civil Servants 2010 (amended and supplemented in the Law on amending and supplementing a number of articles of the Law on Cadres, Civil Servants and the Law on Civil Servants 2019).

People who work under the labor contract regime prescribed in Decree No. 111/2022/ND-CP of the Government on contracts for certain types of work in administrative agencies and public service units are eligible or have an agreement in the labor contract to apply salary classification according to Decree No. 204/2004/ND-CP of the Government on salary regime for cadres, civil servants, public employees and armed forces.

People working within the payroll quota at associations are supported by the state budget for operating expenses according to the provisions of Decree No. 45/2010/ND-CP dated April 21, 2010 of the Government regulating the organization, operation and management of associations (amended and supplemented in Decree No. 33/2012/ND-CP dated April 13, 2012 of the Government).

Officers, professional soldiers, workers, defense officials and contract workers of the Vietnam People's Army.

Officers, non-commissioned officers, police workers and contract workers of the People's Public Security.

People working in key organizations.

Non-commissioned officers and soldiers of the Vietnam People's Army; non-commissioned officers and conscripts of the People's Public Security;

Non-professional activists at commune, village and residential group levels.

The Decree clearly states that the basic salary is used as the basis for calculating salary levels in salary tables, allowance levels and implementing other regimes according to the provisions of law for the above-mentioned subjects; calculating operating expenses and living expenses according to the provisions of law; calculating deductions and regimes enjoyed according to the basic salary level.

For agencies and units that are applying special financial and income mechanisms at the central level: Retain the difference between the salary and additional income in June 2024 of cadres, civil servants and public employees with the salary from July 1, 2024 after amending or abolishing the special financial and income mechanisms.

During the period of not amending or abolishing these mechanisms, the monthly salary and additional income will be calculated based on the basic salary of 2.34 million VND/month according to the special mechanism from July 1, 2024, ensuring that it does not exceed the salary and additional income received in June 2024.

In case of calculation according to the above principle, if the salary and income increase from July 1, 2024 according to the special mechanism is lower than the salary according to general regulations, the salary regime according to general regulations will be implemented.
