Social insurance regime for employees with serious illnesses in 2025

(Dan Tri) - In 2025, sickness benefits for employees participating in compulsory social insurance (SI) will be applied in two phases before and after July 1.


Before July 1

Normally, sick workers will receive support for medical examination and treatment costs from the health insurance fund and sick leave is income to compensate for days off work for medical treatment.

However, in case an employee has a serious illness and requires treatment for many days, there are many superior support policies from Social Insurance.

In the period before July 1, the sick leave regime is applied according to the provisions from Article 24 to Article 29 of the Law on Social Insurance 2014.

According to Vietnam Social Security, Clause 2 and Clause 3, Article 26 of the 2014 Law on Social Security stipulate that employees who take leave due to illness on the List of illnesses requiring long-term treatment issued by the Ministry of Health are entitled to a maximum of 180 days of sick leave (including holidays, Tet holidays, and weekly days off).

During this time, the sick leave benefit is calculated at 75% of the employee's social insurance salary.

If the employee continues to receive treatment after the 180-day sick leave period as above, he/she will continue to receive sick leave benefits at a lower level.

The total maximum sick leave period of an employee is equal to the period of social insurance contribution.

In addition to the above sick leave benefits, during the time off work for medical treatment, employees are also entitled to free health insurance paid for by the Social Insurance Fund.

In addition, according to the provisions of Article 29 of the Law on Social Insurance 2014, employees who have taken sick leave for the required period of time in a year as prescribed, within the first 30 days of returning to work but whose health has not recovered, are entitled to take 5 to 10 days of rest and recuperation in a year.

From 1/7 onwards

From July 1 onwards, the sick leave regime will be applied according to the provisions from Article 42 to Article 49 of the Law on Social Insurance 2024.

Accordingly, almost all regimes for employees with serious illnesses requiring long-term treatment are similar to the 2014 Social Insurance Law. The biggest difference is the duration of sick leave benefits.

Specifically, employees with serious illnesses requiring long-term treatment are also entitled to a maximum period of sick leave benefits in a year based on working conditions and the number of years of social insurance contributions.

During this time, the sick leave benefit is calculated at 75% of the employee's social insurance salary.

If the maximum period of sick leave within a year as above expires and the employee continues to receive treatment, the employee who is absent from work due to an illness on the list of illnesses requiring long-term treatment issued by the Minister of Health shall continue to receive sick leave at a lower level.
