The process of Hau “Phao”’s business deals was as follows: Nguyen Van Hau met with former local officials to ask for policies and pay “bribes”. After receiving a nod, Phuc Son Group would collude with the project investor to be provided with information and bid package estimates.

In such deals, Mr. Cuong was the one who received the disclosed information, from which Phuc Son Group had the conditions and opportunity to win the bid at a very high price, close to the estimated price of the bid package.

Phuc Son Group owner Nguyen Van Hau was proposed to be prosecuted for three crimes: Violating accounting regulations causing serious consequences, Violating bidding regulations causing serious consequences, and Bribery.

In the bid packages that Phuc Son Group aimed for, the Deputy General Director of Phuc Son Group was always the one who received instructions from Nguyen Van Hau to receive and legalize the construction capacity of similar projects; directed subordinate employees to prepare financial reports of Phuc Son Group to inflate revenue figures of the years so that Hau "Phao" could sign as the financial capacity to prepare bidding documents to submit to the investor.

The actions of Mr. Cuong and the owner of Phuc Son Group are said to have been fraudulent, colluding, and colluding with investors to disclose information and bid package estimates to legalize bidding documents. The Investigation Agency believes that Mr. Pham Ngoc Cuong committed the crime of violating bidding regulations causing serious consequences, causing damage to state assets totaling more than 459 billion VND.

The second person that Hau “Pháo” especially trusted and assigned to be the “key keeper” was Hau’s sister, defendant Nguyen Thi Hang. Ms. Hang was accused of violating accounting regulations, causing serious consequences, causing damage to state assets totaling more than 485 billion VND (including more than 361 billion VND in corporate income tax and more than 123 billion VND in VAT).

According to Ms. Hang's testimony at the investigation agency, the defendant, in the role of deputy general director, was assigned by her younger brother, the owner of Phuc Son Group, to receive and manage money collected outside the contract from customers buying land at real estate projects invested by Phuc Son Group and Thang Long Company.

When customers pay, based on Nguyen Van Hau's agreement with the Finance-Accounting Department and the Business Department on the amount of money in and out of the contract for each plot of land, Ms. Hang directs her accountant and secretary to enter data into the computer to track and enter the money collected according to the contract into the companies' accounts. This is for accounting, declaration and reporting purposes.

As for the money collected outside the contract, Ms. Hang transferred it to her younger brother to manage and use. Through that, Ms. Hang coordinated and directly signed a total of 446 contracts of various types and 535 receipts to sell 1,233 plots of land in 4 real estate projects, collecting a total of more than VND 3,338 billion from customers. Of which, more than VND 1,971 billion was not declared or recorded in the books.

The investigation agency believes that Hau "Phao"'s sister must be responsible for more than 485 billion VND in damage to state assets as an accomplice, assisting Nguyen Van Hau in selling 1,233 land lots in projects, leaving the actual revenue off the books.

In addition, every time Hau "Phao" brought money to bribe former officials, Ms. Hang was the one who prepared the money for her brother.

The investigation agency determined that Nguyen Van Hau committed the crime of violating bidding regulations causing serious consequences, causing damage to state assets totaling more than 459 billion VND. In addition, the Chairman of Phuc Son Group also violated accounting regulations causing serious consequences, causing damage to state assets totaling more than 504 billion VND.

The investigation agency determined that Phuc Son Group and Thang Long Company of Nguyen Van Hau sold a total of 1,317 plots of land in 4 real estate projects to 799 customers, earning more than 3,540 billion VND. Of which, only 1,465 billion VND was collected according to the contract for accounting, declaration, and tax reporting, more than 2,072 billion VND was not declared or recorded in the books.
