Kinhtedothi - On the morning of November 19, at a thematic session, the City People's Council approved regulations on converting cadres and civil servants working in communes, wards and towns into cadres and civil servants under the administrative payroll; recruitment, use and management of cadres and civil servants working in communes, wards and towns in the city.
This content is implemented according to the provisions of Clause 1, Article 15, Point a, Clause 3, Article 52 of the Law on the Capital.
According to the report of the City People's Committee, in reality, the staff working in communes, wards and towns in the city according to the provisions of Decree No. 33/2023/ND-CP dated June 10, 2023 of the Government are elected officials, not appointed to civil service positions (only salary is arranged according to the rank). Some officials have not met the prescribed standards (do not have a university degree), or hold the title of official after retirement.
Meanwhile, the ward civil servants are piloting the conversion into administrative civil servants, appointed to the civil servant rank according to Decree No. 32/2021/ND-CP dated March 29, 2021 of the Government (This Decree expires from January 1, 2025). Ward civil servants are recruited by the People's Committees of districts and towns.
The use of ward civil servants is not yet interconnected. When transferring ward civil servants to specialized agencies from the district level and above, it is still necessary to check their suitability with the requirements of the job position. The team of civil servants working in communes and towns in the city has not been appointed to a civil servant rank (only their salaries are arranged according to the rank). Civil servants working in communes and towns are recruited by the People's Committees of districts and towns. Some commune and town civil servants do not have the university degree required for the job position.
In order to convert cadres and civil servants working in communes, wards and towns into cadres and civil servants under the administrative payroll to ensure the standards according to current regulations; to recruit, manage and use civil servants working in communes, wards and towns according to the provisions of the law on cadres and civil servants, it is necessary to issue a Resolution of the City People's Council with legal provisions to long-term implement the conversion of cadres and civil servants in communes, wards and towns into cadres and civil servants under the administrative payroll; to recruit, use and manage cadres and civil servants working in communes, wards and towns in Hanoi.
The purpose of converting cadres and civil servants working in communes, wards and towns into cadres and civil servants according to the provisions of the Law on Cadres and Civil Servants under the administrative payroll is assigned annually to districts, towns and cities under Hanoi; the recruitment, use and management of cadres and civil servants working in communes, wards and towns in Hanoi must ensure the principle of unity, in accordance with regulations and meet the requirements of administrative reform, quickly and effectively.
These contents have not been regulated or are different from the regulations in the Government's documents. At the same time, it overcomes difficulties and shortcomings, and solves practical problems arising in the process of building and developing the Capital. The subjects of application are cadres and civil servants working in communes, wards and towns in Hanoi; relevant agencies, organizations and individuals in Hanoi.
Previously, presenting the review report at the meeting, Head of the Legal Committee of the City People's Council Duy Hoang Duong said that the Legal Committee basically agreed with the contents as in the draft Resolution to specify Clause 1, Article 15 of the Capital Law. At the same time, he emphasized that cadres and civil servants working in communes, wards and towns who are converted into cadres and civil servants under the administrative payroll must ensure the conditions and standards as prescribed for cadres and civil servants to ensure the improvement of the quality of cadres and civil servants in the city.
The conversion of cadres and civil servants working in communes, wards and towns into cadres and civil servants under the administrative payroll; the recruitment, use and management of cadres and civil servants working in communes, wards and towns in Hanoi must be carried out publicly, transparently, in accordance with the standards and subjects as prescribed in the Resolution.
