(TN&MT) - On the morning of October 25, at the National Assembly House, continuing the 8th Session, under the chairmanship of National Assembly Chairman Tran Thanh Man, the National Assembly held a plenary discussion in the hall on a number of contents with different opinions of the draft Law on Urban and Rural Planning. Minister of Construction Nguyen Thanh Nghi spoke to explain and clarify a number of issues raised by National Assembly deputies.
Explaining and clarifying a number of issues at the meeting, Minister of Construction Nguyen Thanh Nghi expressed his gratitude to the National Assembly delegates for actively and responsibly contributing many valuable and diverse opinions on the contents of the draft Law.
Emphasizing that the draft Law on Urban and Rural Planning is an important Law project, directly related to construction projects of enterprises and people, to many provisions of other Laws; as well as many other types of planning... Therefore, in the process of researching and completing the draft Law, Minister of Construction Nguyen Thanh Nghi said that the Drafting Agency and the Agency in charge of reviewing have been very careful, thoroughly reviewing the provisions of the draft Law to ensure consistency with relevant legal provisions on planning...
Regarding the relationship between plans in the urban and rural planning system, Minister of Construction Nguyen Thanh Nghi said that the draft Law clearly stipulates the relationship between general planning, zoning planning and detailed planning, ensuring consistency and synchronization. At the same time, the relationship between urban and rural planning and national and regional planning is also specifically stipulated. “This content has been adjusted in the direction of clearly defining general planning, zoning planning, detailed planning, with the nature of concretization and detailing... These contents have been explained, accepted and clearly explained in Report No. 983 sent to National Assembly delegates,” Minister Nguyen Thanh Nghi stated.
In addition, Minister Nguyen Thanh Nghi said that the scope of urban and rural planning is also determined based on the territorial scope, ensuring the effective interweaving and connection between urban and rural spaces. The Minister said that concepts such as "inner city", "suburb", "outer town" are not within the scope of this draft Law but are regulated in other legal documents.
To ensure feasibility in implementation, Minister Nguyen Thanh Nghi said that the Ministry of Construction will coordinate with ministries and branches to submit to the National Assembly amendments and supplements to related laws such as the Investment Law, Bidding Law, etc. to ensure consistency and unity.
The Minister of Construction said that the draft Law also added a provision allowing the simultaneous establishment of a master plan and in cases where a master plan is approved by a different authority, the master plan with a higher authority will be approved first. In cases where the master plan is approved by the same authority, the master plan that is established and appraised first will be approved first.
Regarding the resolution of problems and conflicts in planning, the draft Law has also revised the provisions in Article 7, separating them into Article 8, in which in case of conflicts between urban and rural plans at the same level, the competent authority approving the planning, or a higher authority deciding on the implementation of the planning, instead of having to carry out the review and adjustment process. In case of conflicts between urban and rural plans at different levels, the planning agencies and organizations shall report to the competent authority approving the planning to carry out the planning adjustment according to regulations.
In case of conflicts with plans of the same level, the content approved by the planning authority must be updated and shown in the planning dossier and the order and procedures must be implemented according to the Government's regulations, to ensure the requirements and principles in urban and rural planning activities. Regarding conflicts between urban and rural planning and other specialized technical plans, Minister Nguyen Thanh Nghi said that the drafting agency and the appraisal agency will continue to review to complete...
Concluding the discussion session, Vice Chairman of the National Assembly Nguyen Duc Hai stated that the delegates highly appreciated the preparation of the report on reception and explanation of the National Assembly Standing Committee, agreed with many contents of the draft law, and at the same time contributed many specific and accurate opinions to complete the draft law, especially on the contents: scope of regulation, subjects of application, urban and rural planning system, interpretation of terms, planning for new urban areas, underground space planning, planning duration and periods, consistency and synchronization with related laws.
The National Assembly Standing Committee will direct the drafting agency, the reviewing agency, and relevant agencies to study and fully absorb comments to complete the explanatory report, absorb and revise the draft law, and complete the draft to submit to the National Assembly for consideration and approval.
