Remove the regulation of minimum average area of ​​25 m2/student when establishing a university?

The Government has just issued Decree 125 regulating conditions for investment and operation in the education sector, in which the conditions for establishing universities and university branches have been adjusted and changed to suit the actual situation.

This Decree takes effect from November 20, 2024, replacing Decree No. 46 (2017) regulating conditions for investment and operation in the education sector and Decree No. 135 (2018) amending and supplementing a number of articles of Decree No. 46.

The new decree removes the regulation that universities must achieve a minimum average of 25 m2/student at the time the school has a stable training scale after 10 years of development.

Accordingly, to be established, a university must have an establishment project in accordance with the approved planning of the university and pedagogical education network. There must be a written approval for the establishment of the school in the province or centrally-run city from the provincial People's Committee where the school is headquartered (except for schools under the provincial People's Committee) and confirmation of land use rights.

Regarding land, the regulation requires that the land area for building the school at the head office must be at least 5 hectares. A requirement of the old decree that "reach an average of at least 25 m2 /student at the time the school has a stable training scale after 10 years of development" is no longer in this decree.

However, the land provision has a new provision that the school construction site must ensure an educational environment and safety for students, teachers, managers and employees; not be located near service establishments, production facilities, warehouses that pollute the environment, are toxic, have a direct risk of fire or explosion and not be located in a dangerous warning area.

For the establishment of private universities, the new regulations still require a minimum investment capital of VND1,000 billion (excluding the value of land for school construction). At the same time, the investment capital is determined by cash and assets prepared for investment and confirmed in writing by the competent authority; by the time of appraisal for permission to establish, the investment value must be over VND500 billion.

Regarding the establishment of a branch of a public university or permission to establish a branch of a private university, the regulation on the minimum construction land area is still 2 hectares as in the old regulation, but the new requirement is not to be located near service establishments, production facilities, warehouses that pollute the environment, are toxic, have a direct risk of fire or explosion, and are not located in a dangerous warning area.

In addition, there is no longer a requirement to achieve a minimum average of 25 m2 /student at the time the branch has a stable training scale after 10 years of development.

A branch of a private university must have a minimum investment capital of VND 250 billion (excluding the value of land for building the branch) and the investment value by the time of appraisal for permission to establish the branch must be over VND 150 billion.
