The draft Law on Organization of Local Government (amended) proposes a number of transitional provisions to ensure smooth local government operations.

This is one of the notable contents in the draft Law on Organization of Local Government (amended) that has just been released by the Ministry of Home Affairs for comments.

Specifically, the bill clearly states: People's Councils, agencies under People's Councils, People's Committees, Chairmen of People's Committees, specialized agencies under People's Committees of districts, towns, cities under provinces, cities under centrally run cities, and towns will cease to perform their duties, powers, and cease operations from July 1, 2025.

In addition, the bill also stipulates that the organization of local government in wards of Ho Chi Minh City and Da Nang City for the 2021-2026 term will continue to be implemented until the People's Committee of the ward for the 2026-2031 term is elected.

The adjustment of tasks and powers of the District People's Committees (before dissolution) of Ho Chi Minh City and Da Nang City for the City People's Committees and Ward People's Committees of these two cities is stipulated by the National Assembly until the City People's Committees and Ward People's Committees of Ho Chi Minh City and Da Nang City for the 2026-2031 term are elected.

According to the Ministry of Home Affairs, the amendment and supplement to the current Law on Organization of Local Government is to ensure consistency with the provisions of the 2013 Constitution (after amendment and supplement) on local government in the context of implementing the Party's policy on streamlining the organization and apparatus of the political system (no district-level organization, implementing a 2-level local government model).

To ensure that local government operations are not interrupted when converting the model from a 3-level government to a 2-level government, the Ministry of Home Affairs proposes to develop transitional regulations such as the deadline for the Government to redistribute tasks and powers of local governments, the deadline for district levels to hand over work, etc.

End of the urban government model

In addition, to resolve issues arising from the conversion of the local government organization model from 3 levels to 2 levels, the Ministry of Home Affairs also proposed a bill to terminate the urban government organization model currently being implemented in Hanoi, Ho Chi Minh City, Da Nang, and Hai Phong.

Accordingly, the draft law stipulates that from July 1, all articles, clauses, and chapters in a number of laws and resolutions related to the organization of urban government will be abolished or abolished.

Specifically, the following contents are abolished: Chapter 2 of the Capital Law; Resolution No. 169 of the National Assembly on the organization of urban government in Hai Phong.

From May 1, 2026, Resolution No. 131 of the National Assembly on the organization of urban government in Ho Chi Minh City will expire; Articles 7 and 8 of Resolution No. 136 on the organization of urban government and piloting a number of specific mechanisms and policies for the development of Da Nang city will be abolished...

The draft revised Law on Organization of Local Government will be considered by the National Assembly at its 9th session scheduled to open in early May.
