The Ministry of Education and Training was found to have laxed management, allowing violations in the organization of foreign language proficiency exams.
The Government Inspectorate has just issued an inspection conclusion at the Ministry of Education and Training, related to the implementation of public service responsibilities in handling administrative procedures (AP) and providing public services.
In addition to the achieved results, through the inspection of 10 administrative procedures and 18 administrative procedure settlement records at the Department of Organization and Personnel, the Department of Quality Management and the Department of International Cooperation, the inspection agency discovered many shortcomings and violations.
Long-standing violations but slow to correct
One of the shortcomings pointed out by the Government Inspectorate is the management and settlement of administrative procedures "approving joint organization of foreign language proficiency exams" before Circular No. 11/2022 of the Ministry of Education and Training takes effect (from August 2028 to September 2022).
The Ministry of Education and Training was found to have been lax in its management, allowing violations in the organization of foreign language proficiency certification exams. Specifically, many units organized certification exams without permission from the Ministry of Education and Training as stipulated in Decree 86/2018.
The above violations have occurred for a long time, but there have not been timely measures to prevent, correct, and handle them, causing public outrage.
The Government Inspectorate recommends that the Ministry of Education and Training organize a review, implement within its authority or recommend to competent authorities measures to rectify, handle violations, and remedy consequences (if any) for relevant organizations, units, and individuals in the field of joint organization of foreign language proficiency certificate exams to ensure compliance with legal regulations.
The handling must ensure the legitimate rights and interests of those taking the certificate exam; at the same time, rectify the approval of joint activities to organize certificate exams, ensure strict compliance with relevant legal regulations, be public and transparent, and not let negativity and frustration arise in society.
Overdue file but no serious apology
According to the inspection conclusion, the Ministry of Education and Training reported that the results of handling administrative procedure records did not reflect the actual situation and were inaccurate.
This agency reported to the Government that the results of timely settlement in 2021 - 2022 were 100%. However, with only 10 administrative procedures subject to inspection, the Government Inspectorate discovered that 419 files were overdue, accounting for 2.27% of the files resolved. Of which, 3 administrative procedures had an overdue settlement rate of over 50%.
Although many procedures are overdue, the agency handling administrative procedures does not seriously apologize to people and businesses.
Some units at the Ministry of Education and Training were also found to have asked people and businesses to supplement and complete documents outside the list of prescribed documents, causing frustration, inconvenience, and potential harassment.
Notably, the inspection conclusion determined that the Department of International Cooperation of the Ministry of Education and Training issued graduation certificates for 3 administrative procedure files "receiving state budget scholarship students who have graduated and returned to the country" without authority; the appraisal of 3 administrative procedure files "amending decisions, changing locations of representative offices" did not follow the correct procedures.
The Department of Quality Management also issued certificates of diploma recognition not in accordance with the prescribed procedures for 2 records of the administrative procedure "diploma recognition...".
Review the responsibility of the leaders of the Ministry of Education and Training
Based on the inspection conclusion and direction of the Prime Minister, the Government Inspectorate requests the Ministry of Education and Training to review the responsibility of the head and the responsibility of the leaders of the ministries directly involved in the shortcomings, defects and violations mentioned above.
According to its authority, the Ministry of Education and Training directs and reviews the leaders of departments, divisions, units, collectives and individuals under the ministry related to the shortcomings, defects and violations mentioned in the inspection conclusion.
