The Ministry of Home Affairs proposed decentralizing state management to Ho Chi Minh City in 9 sectors and fields to create conditions to promote proactiveness and creativity in promptly and effectively resolving issues arising in the area.
The draft Decree on decentralization of state management in some areas to the Ho Chi Minh City government has just been sent by the Ministry of Home Affairs to the Ministry of Justice for appraisal.
According to the Ministry of Home Affairs, many contents on decentralization of management of some areas to the Ho Chi Minh City government in Decree 93/2001 have now been specified in legal documents such as Laws, Resolutions of the National Assembly, Decrees of the Government stipulating general authority for all provinces and centrally-run cities, no longer decentralizing specifically to Ho Chi Minh City.
"Many contents on decentralization of management of some areas to the Ho Chi Minh City government are no longer consistent with current legal regulations and are no longer suitable for practice to create motivation to promote the city's development," the Ministry of Home Affairs commented.

The draft developed by the Ministry of Home Affairs proposes decentralization to the Ho Chi Minh City government in 9 groups of sectors and fields.
Firstly , in state management of investment, Ho Chi Minh City decided to update and supplement the List of newly-emerged investment incentive industries, occupations, and locations according to the world's technological development trends and from the practice of socio-economic development.
The People's Committee submitted to the People's Council of Ho Chi Minh City to issue support policies for high-tech enterprises, science and technology enterprises, science and technology organizations, enterprises investing in agriculture, rural areas, education, law dissemination and other subjects.
The City may also decide to adjust and extend the operating period of investment projects to build and operate infrastructure in export processing zones and industrial parks according to Decree 31/2021 of the Government.
Second , in economic, financial and state budget management, Ho Chi Minh City is allowed to decide on salary and allowance spending regimes in addition to the regimes, standards and spending norms issued by the Government, Prime Minister and Minister of Finance to carry out socio-economic development tasks, ensure social order and safety in the area, in accordance with the balancing capacity of the city budget, the central budget does not support, without having to consult with relevant ministries and branches.
Ho Chi Minh City can issue appropriate budget spending regimes, standards, and norms (except for norms for using public cars) and use funds from the city budget to pay for the difference.
Local authorities grant and adjust licenses to establish retail establishments without consulting the Ministry of Industry and Trade.
Third , regarding state management in the fields of planning, construction, natural resources and environment, the Ministry of Home Affairs proposed that Ho Chi Minh City decide on the population size of social housing projects to ensure appropriateness, corresponding to the indicators on land use coefficient or increased construction density.
Ho Chi Minh City can grant, extend, re-grant, and revoke certificates of eligibility for occupational safety technical inspection activities under the management authority of the Ministry of Construction; assign Ho Chi Minh City Police to review and approve fire prevention and fighting designs for level I construction works.
Localities are allowed to decide on the order, procedures, criteria, standards, and scale of construction of temporary works serving agricultural production on agricultural land or other agricultural land not for residential or business purposes.
Fourthly , in the field of transportation, the People's Committee of Ho Chi Minh City has the authority to perform state management of inland waterway traffic activities on national inland waterways within the administrative boundaries of the city.
The City performs specialized state management of transportation at inland waterway ports, inland waterway wharves, and anchorage areas for national inland waterways, specialized inland waterways connecting national inland waterways, seaport waters... within its administrative boundaries.
Fifth , in health management, the draft proposes to assign specialized agencies to issue certificates of advertising content for medical examination and treatment services of non-public hospitals in Ho Chi Minh City. Decide to grant import licenses for drugs to meet special treatment needs in the area, arising during the medical examination and treatment process for some groups of drugs; periodically inform the Ministry of Health to monitor, inspect and supervise.

Sixth, in the management of education and training, vocational education, Ho Chi Minh City is allowed to publish local educational materials (when there is no mechanism for printing and publishing local educational materials); build pilot school models to improve the quality of local education (when there are no specific regulations).
Seventh , in labor management, Ho Chi Minh City approves the explanation of the need to use foreign workers; confirms that they are not subject to work permit issuance; issues, reissues, extends and revokes work permits for organizations, agencies and enterprises with headquarters operating in the area.
8. In the field of science and technology, Ho Chi Minh City is allowed to grant and revoke certificates for organizations and individuals operating in high-tech application, high-tech research and development, and high-tech enterprises in the area.
The City is authorized to grant and revoke certificates of high-tech incubators; inspect and supervise the maintenance of operating conditions of high-tech incubators.
9th , in state management of internal affairs, the draft proposes to allow Ho Chi Minh City to decide to establish, separate, merge, and consolidate specialized agencies under the City People's Committee, ensuring that it is suitable to local characteristics and does not increase the number of existing specialized agencies.
Decide on additional bonuses for collectives and individuals with outstanding or exceptionally outstanding achievements in the cause of building and defending the Fatherland and contributing to promoting the socio-economic development, national defense and security of Ho Chi Minh City in addition to the bonus level according to current regulations.
Ho Chi Minh City decides to establish, separate, merge, and consolidate specialized agencies under the People's Committees of districts, ensuring that they are suitable to the characteristics of the city; decides on the number of deputies of heads of public service units...
Opinions still differ
The Ministry of Home Affairs said there are still different opinions between Ho Chi Minh City and a number of ministries managing sectors and fields on the content of the proposal to decentralize to the city government.
"The Ministry of Home Affairs has reviewed and completed the draft decree to ensure that it is consistent with the scope of the decree, the principles of decentralization, the authority of the decentralizing entity and the decentralizing recipient. The Ministry of Home Affairs will fully synthesize different opinions after receiving appraisal opinions from the Ministry of Justice and opinions of Government members," the agency said.
