What are the fire prevention and fighting requirements for apartments?

1. What is an apartment?

Pursuant to Clause 3, Article 3 of the 2014 Housing Law, an apartment building is a building with 2 or more floors, many apartments, common walkways and stairs, private ownership, common ownership and a system of infrastructure works for common use by households, individuals and organizations, including apartment buildings built for residential purposes and apartment buildings built for mixed-use purposes of residence and business.

2. What are the fire prevention and fighting requirements for apartments?

According to Clause 2, Article 4 of Decree 136/2020/ND-CP, apartment buildings are subject to fire prevention and fighting management.

Accordingly, apartment buildings must meet the following fire safety requirements for facilities:

* For apartment buildings with 5 floors or more or with a volume of 5,000 m3 or more:

(i) There are regulations, prohibition signs, warning signs, diagrams or signs indicating fire prevention and fighting and escape routes in accordance with fire prevention and fighting regulations and standards or as prescribed by the Ministry of Public Security;

(ii) Having a fire prevention and fighting force at the facility, specialized in the type of facility, trained in fire prevention and fighting and organized to be ready to fight fires to meet on-site fire fighting requirements as prescribed, except for the case specified in Point g, Clause 3, Article 31 of Decree 136/2020/ND-CP;

(iii) Have a fire fighting plan approved by a competent authority;

(iv) Electrical systems, lightning protection, anti-static systems, electrical equipment, fire-generating and heat-generating equipment, the use of fire and heat sources must ensure fire prevention and fighting safety in accordance with fire prevention and fighting regulations and standards or according to regulations of the Ministry of Public Security;

(v) There is a traffic, water supply, and communication system serving fire fighting, a database management system on fire prevention, fire fighting, and incident reporting, a fire alarm, fire fighting, fire prevention, smoke prevention, escape system, other fire prevention and fire fighting equipment, and rescue equipment that ensure quantity and quality in accordance with fire prevention and fighting standards or regulations of the Ministry of Public Security;

(vi) Have a Certificate of design approval and design approval document (if any) and a document approving the results of fire prevention and fighting acceptance by the Fire Prevention and Fighting Police Department for projects and works in the list specified in Appendix V issued with Decree 136/2020/ND-CP.

Except for defense facilities operating for military purposes and motor vehicles with special requirements for ensuring fire prevention and fighting safety manufactured or converted by defense facilities specifically for military activities.

* For apartments under 5 floors and with a volume of less than 5,000 m3

- The conditions specified in points (i), (iii) and point (iv) ; in case the facility is on the list specified in Appendix V of Decree 136/2020/ND-CP, it must have a Certificate of design approval and design approval document (if any) and a document approving the results of fire prevention and fighting acceptance;

- There is a traffic system, water supply, communication system for fire fighting, fire alarm system, fire fighting, fire prevention, smoke prevention, escape, other fire prevention and fighting equipment, rescue equipment ensuring quantity and quality in accordance with technical standards and regulations on fire prevention and fighting or according to regulations of the Ministry of Public Security;

- There are regulations and assignments of responsibilities and tasks for fire prevention and fighting. People in charge of fire prevention and fighting must be trained and fostered in fire prevention and fighting skills according to the provisions of Article 33 of Decree 136/2020/ND-CP.
