On the afternoon of November 7, comrade Nguyen Van Thi, member of the Provincial Party Standing Committee, Permanent Vice Chairman of the Provincial People's Committee chaired a conference to listen to reports and consider the issuance of contents related to regulations on the level of expenditure to ensure the organization of compensation, support and resettlement when the State recovers land and the process of circulating records to determine financial obligations on land in the province.
The representative of the Department of Finance presented the draft on the level of expenditure to ensure the organization of compensation, support and resettlement when the State acquires land.
According to the draft resolution on regulations on expenditure levels to ensure the organization of compensation, support and resettlement when the State acquires land in Thanh Hoa province, this expenditure level is applied to agencies, organizations and individuals involved in the preparation, approval of estimates, use and settlement of expenditures to ensure the organization of compensation, support and resettlement when the State acquires land.

Accordingly, the resolution specifically stipulates the expenditure levels for a number of contents such as: expenses for organizing meetings with land owners and property owners in the recovered area to disseminate and propagate policies and laws on compensation, support, resettlement and receive opinions, organize mobilization; expenses for investigation, survey, recording the current status, measuring, counting, statistics, classifying land area and determining the origin of land and property attached to the recovered land; expenses for establishing, appraising, approving, and publicizing compensation, support, and resettlement plans from the stage of calculating and determining the level of compensation and support to the stage of approving the plan, publicly announcing the compensation, support, and resettlement plan; expenses for organizing the payment of compensation, support, and resettlement according to the compensation, support, and resettlement plan approved by competent state agencies according to regulations; Expenses for guiding implementation and resolving difficulties in organizing the implementation of compensation, support and resettlement plans approved by competent state agencies according to regulations... with specific daily costs.

Discussing at the conference, representatives of departments, branches and localities proposed that the resolution should stipulate and clarify the total cost ceiling to ensure the implementation; at the same time, supplement the content and level of expenditure for land inventory, enforcement and recovery; consider separating and having separate levels of expenditure for some contents of the work: extracting cadastral measurements of land plots for land plots in places where there are no cadastral maps to serve compensation and site clearance; measuring and determining the actual area of land plots within the boundary of the recovered land to implement the project...

Speaking at the conference, Permanent Vice Chairman of the Provincial People's Committee Nguyen Van Thi said that after the Land Law 2024 No. 31/2024/QH15 and decrees took effect, Thanh Hoa province has been promoting the issuance of guiding documents; supplementing mechanisms and policies to create a legal basis for localities to carry out compensation and site clearance work, promote the implementation of public investment projects and direct investment projects.
The Department of Finance is requested to absorb the opinions of departments, branches and localities, with the goal of building a resolution on the basis of compliance with legal regulations, easy to implement and ensuring effective implementation.
Accordingly, he proposed that the draft resolution should be supplemented and revised in the direction of: regulating the ceiling cost for organizing the implementation of compensation, support, and resettlement when the State acquires land not exceeding 3%. With the contents related to the work of measuring, counting, enforcing land acquisition and dismantling works to be separated; at the same time, localities should base on relevant legal regulations to make estimates and be responsible before the law in organizing the implementation.

Regarding the content of the process of transferring records to determine financial obligations on land, according to the draft developed by the Department of Natural Resources and Environment, the draft clearly stipulates the process and order for each specific case such as: The process of transferring records to determine financial obligations on land in cases where the State allocates land or leases land without auctioning land use rights; permits the change of land use purpose; changes in land use form; adjusts decisions on land allocation, land lease, permits the change of land use purpose; adjusts detailed planning; extends land use; adjusts land use duration; permits the use of land for multiple purposes in accordance with the provisions of law; registers land and assets attached to land, grants certificates of land use rights and ownership of assets attached to land for the first time.

Concluding this content, Standing Vice Chairman of the Provincial People's Committee Nguyen Van Thi requested the Department of Natural Resources and Environment to absorb comments from departments, branches and localities; supplement necessary legal bases, ensure that the draft process is built tightly and convincingly on the basis of simplifying procedures and processes; and implement effectively and transparently.
In particular, the Department of Natural Resources and Environment noted that it is necessary to supplement the information mechanism related to the confirmation of tax payment obligations, which should be applied according to the one-stop mechanism, interconnected between State agencies; maximally apply modern information methods, creating the most favorable conditions for organizations and individuals when implementing financial obligation procedures on land.
The comrade assigned the Department of Natural Resources and Environment to edit and complete the draft before November 12 so that the Provincial People's Committee Office can coordinate with the Justice Department to complete it and submit it to the Provincial People's Committee at the meeting in November 2024.
