Delegate Tran Huu Hau (Tay Ninh) said that if in the performance of public duties, to perform one's duties well, there are clear and appropriate regulations and legal corridors, then certainly the majority of civil servants and public employees will only need to make efforts, be creative, and find more effective ways of doing things, there is nothing to be afraid of.
However, in reality, in many cases, if we decide to do it to meet practical requirements and bring efficiency to the people and the country, we must violate current regulations and laws of the State. "Therefore, those who see that doing things that violate regulations and laws, even for the common good, but are not afraid, are probably "deaf to guns" or lack a sense of organization and discipline," said delegate Tran Huu Hau.
From there, delegate Tran Huu Hau expressed his opinion that protecting people who dare to think and dare to do seems impossible, because in many cases like that, it means protecting actions that are against regulations and against the law. Then there is a need to protect people who dare to think and dare to do. Delegate Tran Quoc Tuan (Tra Vinh) said that there are currently two groups of officials who are afraid of responsibility. One is officials who have degraded political ideology, officials who avoid, are afraid of responsibility, push things away, are afraid of making mistakes, and do not want to do it because there is no benefit. The other is officials who are afraid of violating the law so they do not dare to do it. Delegate Tran Quoc Tuan suggested that the National Assembly and the Government should focus on researching, reviewing, amending and supplementing all legal provisions, especially sub-law documents, to ensure strictness, consistency and ease of application. Further promote decentralization and delegation of power. If this work is done well, it will reduce pressure and burden on higher-level agencies, while increasing responsibility for localities and lower-level agencies. To do so, it is necessary to determine which tasks are the responsibility of localities, boldly delegate power to localities, and localities will be responsible before the law. At the same time, continue to strengthen inspection and supervision to guide, remind and urge effective implementation of public duties. |
"That's why it's common for subordinates to ask for opinions from superiors, wait for instructions from superiors, and even be assigned clear tasks, but the deeper they go into implementing them, the more entangled they become, so they have to go back to superiors to ask for opinions before doing it," delegate Tran Huu Hau analyzed.
According to delegate Tran Huu Hau, looking back at the development and promulgation of the decree on encouraging and protecting those who dare to think and dare to do, it seems to be almost the same. On this issue, the Politburo has issued Conclusion 14, the 6th Central Conference has issued Resolution 28, the National Assembly has assigned tasks in Resolution 75 in 2022, the Government and the Prime Minister at the regular meeting in February 2023 and Official Dispatch 280 have assigned the Ministry of Home Affairs to urgently implement the draft decree and report to the Government in June.
“The direction and guidance are very clear. However, after three revisions to the draft and consultation, the Ministry of Home Affairs found that there were many legal regulations that were in conflict, so it is consulting and reporting to the National Assembly Standing Committee to issue a pilot resolution to encourage and protect officials who dare to think and dare to do. After that, the Government will issue a decree,” said delegate Tran Huu Hau.
All agencies do the right thing, but the urgent matters of the people and the country are frozen.
From the above analysis, delegate Tran Huu Hau said that it is necessary to make sure that cadres, civil servants and public employees at all levels do not have to dare to think, dare to do, and do not need to be encouraged and protected by their superiors. Cadres, civil servants and public employees at all levels need to focus their efforts and intelligence to be proactive and creative in performing their work most effectively for the people and the country within the framework of Party regulations and State laws. To do so, when discovering that laws and regulations are not suitable, they should focus on immediately amending them with a strict, yet simple and concise process.

Delegate Tran Huu Hau expressed in response to the Prime Minister’s question: “The law is ours. In practice, it is stuck, and the stuck is what we set up. So we have to fix it.”
However, delegate Tran Huu Hau emphasized that it is too difficult to correct the irrationalities that we ourselves have created. There are many issues that when brought up for discussion, each cadre and each relevant agency has their own arguments and they all seem to be right. Unfortunately, in many cases, when most individuals and relevant units are right, trying to perform their best and most accurately according to their functions and powers, there are some urgent issues of the people and the country that are frozen.
"We cannot accept such illogical and contrary phenomena. The right with the right must bring about openness, must help the country develop, and must meet the people's expectations. The right with the right cannot lead to stagnation, to impoverishing the country," said delegate Tran Huu Hau.

We have come up with the right solution, which is to issue a resolution of the National Assembly to promptly resolve difficulties and obstacles in practice, or to amend many laws with one law. Emphasizing this, delegate Tran Huu Hau suggested that the National Assembly consider having more appropriate methods, procedures, and processes to promptly resolve arising obstacles. Thus, cadres, civil servants, and public employees have to dare to think less, dare to do less, and focus their strength and intelligence to be proactive and creative in performing their duties and tasks better in the openness of legal regulations.
