In the process of clarifying the case of "Discovering a "super-fraudulent doctor" who faked information about teaching at universities and colleges", Dan Tri reporters have accessed surprising information about the degree bearing Mr. NTH's name - used by a man to teach at a series of universities and colleges in recent years.

Accordingly, the notarized master's degree that Mr. H. provided when applying for a job showed something unusual. In particular, the degree had the detail of "thesis defense" dated December 31, 2009. This is not suitable for the process of granting a master's degree because the requirement in this system is only a thesis.

Along with that, an official of the University of Natural Sciences, Ho Chi Minh City National University confirmed that on the doctoral degree bearing the name of NTH, the signature bearing the name of Associate Professor, Dr. Tran Le Quan - the school's principal - was actually that of the former principal, Professor, Dr. Tran Linh Thuoc.

"This creates the phenomenon of 'this man's beard on that woman's chin' when attaching one person's signature to another person's name," this person said.

In addition, another doctoral degree bearing the name NTH was sent by Vietnam College of Industry and Trade to the University of Natural Sciences, Ho Chi Minh City National University, with the certificate number QH: 22086798528xx issued in 2021. The certificate registration number is 22-TS/2022/18N111xx.

Thus, the year of issue is 2021 but the number entered in the book is the symbol of 2022. This problem is also often illogical when entering the diploma book.

With a series of inconsistencies above, the file named NTH reveals doubts that are easily seen with the naked eye.

However, in reality, Mr. NTH passed through a series of universities and colleges to teach at undergraduate and graduate levels.

What are the responsibilities of the notary public?

During the job application process, Mr. NTH used notarized documents in his application, which were later determined to be incorrect. Therefore, in addition to Mr. H.’s personal responsibility, if the notarized documents are determined to be correct, the notary office also has related responsibilities in this matter.

Lawyer Luong Ngoc Dinh - Director of Thinh Viet Tri Law Company Limited - said that Clause 2, Article 7 of the 2014 Notarization Law strictly prohibits individuals and organizations from performing the following acts: "A person requesting notarization shall provide false information or documents; use forged or illegally erased or modified documents or papers to request notarization".

"Mr. NTH's behavior, if true as reported in the press, is a violation of the law and will be punished.

Using fake documents to request notarization will be subject to administrative penalties, but if it goes beyond the administrative framework, criminal liability may be prosecuted.

In case of damage, compensation must be made according to the law," said lawyer Ngoc Dinh.

Specifically, Clause 3, Article 12 of Decree 82/2020/ND-CP stipulates administrative sanctions for violations in the fields of judicial assistance; judicial administration; marriage and family; civil judgment enforcement; bankruptcy of enterprises and cooperatives, effective from September 1, 2020 as follows: A fine of 20 to 30 million VND for the act of providing false information and documents to notarize translations.

In addition, violators must be subject to additional penalties such as: Confiscation of evidence, which are documents and papers that have been erased or altered to distort the content for violations specified in Clause 1 of this Article.

For notary units that perform the certification of copies, when the competent authority receives a certification request and the person performing the certification suspects or discovers that the certified documents or papers are fake, they have the rights as prescribed in Article 9 of Decree 23/2015/ND-CP:

Units are required to request relevant agencies, organizations and individuals to provide necessary information to verify the legality of documents and papers requiring certification; make a record of temporary detention and transfer to a competent State agency for handling in accordance with the provisions of law for documents and papers requiring certification that are issued without authority, forged or have the content specified in Clause 4, Article 22 of this Decree.

The remedial measure for notary units as prescribed in Clause 5, Article 12 of Decree 82/2020/ND-CP is to force the notary organization that is storing notarized records to notify the relevant agencies, organizations and individuals with rights and obligations about the violations prescribed in Clause 2, Points a, b and c, Clause 3 of this Article.

Notary public units are responsible for recommending competent agencies, organizations and individuals to review and handle documents and papers that have been erased or modified to distort the content specified in Clause 1 of this Article.

Lawyer Ngoc Dinh added that in case the person with authority to notarize or authenticate a copy of a fake document is irresponsible and causes serious consequences, the notary or certifier must also bear criminal responsibility according to the provisions of Article 360 ​​of the 2015 Penal Code, amended and supplemented in 2017.

Mr. Huynh Van Chuong - Director of the Department of Quality Management (Ministry of Education and Training) - said that according to regulations, verifying diplomas is the responsibility of the diploma-granting agency, not the responsibility of the Ministry of Education and Training.

"Educational institutions need to publicize all issued diplomas and certificates according to regulations to facilitate relevant parties' search and social supervision. This is included in the circular on diploma and certificate management.

In the near future, the Department of Quality Management will advise on inspection and strict supervision of the issuance of diplomas and certificates of educational institutions," said Mr. Chuong.
