The Ministry of Public Security is drafting the Law on Traffic Order and Safety. This law is partly separated from the 2008 Law on Road Traffic.
At present, people still need to carry vehicle documents when participating in traffic.
According to the draft, when participating in traffic, drivers must carry four types of documents: vehicle registration, driver's license, technical safety and environmental protection inspection certificate, and compulsory civil liability insurance certificate.
In the above documents, if the information of any document has been integrated into the electronic identification account or identity card according to regulations, the driver does not need to carry it anymore.
For traffic police, the draft stipulates that in cases where vehicle documents have been integrated, inspection and control must be carried out through authenticating such information and documents on the electronic identification account.
Also related to vehicle document data integration, Circular 32/2023 of the Ministry of Public Security (effective from September 15) stipulates that when drivers provide information of documents in the electronic identification account, the Traffic Police force will check and compare the information of those documents in the electronic identification account.
During the inspection process, if an electronic identification account is found to be counterfeit or an individual or organization has committed a violation that requires temporary detention, revocation of the right to use, revocation, or confiscation of documents, or violations requiring verification of documents, the Traffic Police will request the presentation of those documents for handling in accordance with the provisions of law.
After many efforts by the police and the people, millions of driver's licenses have been integrated into the VNeID electronic identification application. However, at present, the traffic police force has not yet applied information authentication on the application instead of directly checking vehicle documents.
Responding to this issue, at a discussion on draft laws chaired by the Ministry of Public Security, Major General Pham Cong Nguyen, Director of the Department of Legislation and Administrative and Judicial Reform (Ministry of Public Security), said that any change requires preparation time.
The preparations that the director mentioned include infrastructure, databases, equipping knowledge for management agencies and most importantly, changing people's habits.
The same goes for electronic ID (VNeID application). When people fully integrate documents and change their habit of using paper documents, state management agencies are fully equipped with infrastructure (reading devices, terminals, etc.) and are fully trained, then electronic ID can replace traditional documents.
During the transition, the Ministry of Public Security has made open regulations on the methods by which people can perform public services, so that they can see the benefits and conveniences brought about, thereby voluntarily converting.
Lawyer Ha Cong Tam, Hanoi Bar Association, said that while the draft Law on Road Traffic Order and Safety has not been passed, and the documents integrated on the VNeID application have not been accepted to replace hard copies, traffic participants still have to carry documents such as vehicle registration, driver's license, etc.
According to Decree 100/2019 (supplemented by Decree 123/2021), drivers of motorbikes and mopeds who do not carry their vehicle registration or driving license will be fined from 100,000 to 200,000 VND. The fine will be doubled for drivers of cars, tractors and vehicles similar to cars.
