On the evening of October 28, according to Thanh Nien reporter's source, the Department of Justice of Ca Mau province agreed on how to handle the administrative violation case against Quoc Viet Ca Mau Company Limited and Van Cuong Construction Joint Stock Company, which the People's Committee of Thoi Binh district had previously not imposed administrative penalties on the two companies despite having sufficient grounds to do so.
Request for self-withdrawal of report on non-handling of administrative violations
The Department of Justice of Ca Mau province determined that the establishment of procedures and initial inspection records by the Inland Waterways Inter-sectoral Inspection Team No. 1 (under the Traffic Safety Committee of Ca Mau province) was sufficient basis for the Chairman of the People's Committee of Thoi Binh district to draw up a record of administrative violations and issue a decision to impose administrative sanctions on Quoc Viet Ca Mau One Member Co., Ltd. and Van Cuong Construction Joint Stock Company according to the provisions of law.

The Department of Justice of Ca Mau province also agreed with the proposal of the People's Committee of Thoi Binh district to self-recall Report No. 833 dated October 10, 2023 on the results of handling violations in the field of inland waterway traffic. At the same time, establish procedures to handle administrative violations against the company according to the provisions of law.
The Department of Justice of Ca Mau province also requested the Chairman of the People's Committee of Thoi Binh district to direct the review and handling of the responsibilities of organizations and individuals in advising on the issuance of documents refusing to impose administrative sanctions on Quoc Viet Ca Mau Company Limited and Van Cuong Construction Joint Stock Company without legal basis, leading to the delay in handling administrative violations according to the provisions of law.
Violation known and signs removed and operations discontinued
Previously, last September, Inland Waterways Joint Inspection Team No. 1 discovered 2 cases of violations of inland waterways in Thoi Binh District.
Accordingly, on September 14, while inspecting the wharf of Quoc Viet Ca Mau Company Limited, the authorities discovered that the wharf owner had allowed the ST-06234 vessel to anchor and unload goods at a location that had not been announced or licensed to operate an inland waterway wharf according to regulations.
On September 22, the inspection team of the Van Cuong Joint Stock Construction Company's wharf, the representative could not present documents related to the decision to announce the operation of inland waterway wharfs and anchorage areas according to regulations, violating the unauthorized installation of inland waterway signals.
In response to the above violations, the Inland Waterways Joint Inspection Team No. 1 drew up a report and assigned it to the People's Committee of Thoi Binh District for handling. However, the People's Committee of Thoi Binh District later reported on the inspection and handling of violations at the two unlicensed inland waterway terminals mentioned above.
Specifically, for the wharf of Quoc Viet Ca Mau Company Limited, after the Inland Waterways Inter-sectoral Inspection Team No. 1 inspected and made a record, the company carried out related procedures to submit to the competent authority to grant a license to operate the inland waterway wharf to serve the construction of the main project and was announced by the district in Decision No. 5228 dated October 2, 2023.
Regarding the case of Van Cuong Construction Joint Stock Company, Thoi Binh District's report stated that the company knew about the violation and had removed the waterway signs.
Regarding the violation of anchoring and loading and unloading goods at locations that have not been announced or licensed to operate inland waterway ports according to regulations. Currently, Van Cuong Joint Stock Construction Company has stopped anchoring and loading and unloading goods at the above-mentioned violating location. At the same time, it committed not to operate illegally and to carry out procedures to submit to the competent authority for licensing. Therefore, Thoi Binh District People's Committee did not issue a decision to impose administrative penalties on the two companies violating the above inland waterway ports.
