From January 1, 2025, the Law on Road Traffic Order and Safety will come into effect with many new points on driver's license classification. The law stipulates 15 classes including: A, A1, B, B1, C, C1, D, D1, D2, BE, C1E, CE, DE, D1E, D2E, an increase of 2 classes compared to the current law.

In which, class A1 is granted to drivers of two-wheeled motorbikes with a cylinder capacity of up to 125 cm3 or an electric motor capacity of up to 11kW. Class A is granted to drivers of two-wheeled motorbikes with a cylinder capacity of over 125 cm3 or an engine capacity of over 11kW and the types of vehicles specified for class A1 driving licenses.

Class B1 is granted to drivers of three-wheeled motorbikes and vehicles specified for class A1 driving license.

For cars, class B license is for drivers of vehicles with up to 8 seats (excluding the driver's seat); trucks and special-purpose vehicles up to 3.5 tons. Compared to the 2008 Road Traffic Law, class B has been combined between the B1 license (issued to non-professional drivers of cars with up to 9 seats; trucks under 3.5 tons) and the B2 license (issued to professional drivers of vehicles with up to 9 seats; trucks under 3.5 tons).

The previous Class C driver's license for driving trucks of 3.5 tons or more is split into C1 (for driving 3.5-7.5 tons) and C (over 7.5 tons).

Class D, previously granted to drivers of passenger vehicles with 10 to 30 seats, is divided into classes D1 (from 8 to 16 seats, excluding the driver's seat) and D2 (from 16 to 29 seats), and class D (over 29 seats).

Class BE is granted to drivers of vehicles specified for Class B driving licenses pulling trailers with a total designed weight of over 750 kg.

Similarly, classes C1E, CE, D1E, D2E, DE are granted to drivers of class C1, C, D1, D2, D cars pulling trailers with a total design weight of over 750 kg.

The new law inherits the current law and guiding documents stipulating that driving licenses of classes A1, A, B1 are indefinite; class B and class C1 licenses are valid for 10 years; class C, D1, D2, D licenses and trailer driving licenses are valid for only 5 years.

Regarding driving age, the new law stipulates that people aged 16 and over are allowed to drive motorbikes (with a capacity of less than 50 cm3; electric motor no larger than 4 kW); people aged 18 and over are granted driving licenses of classes A1, A, B1, B, C1.

People aged 21 and over are granted driving licenses of class C, BE; people aged 24 and over are granted driving licenses of class D1, D2, C1E, CE; people aged 27 and over are granted driving licenses of class D, D1E, D2E, DE.

Explaining the increase in the number of types of driving licenses from 13 to 15, Lieutenant Colonel Ta Thi Hong Minh, Deputy Head of the Department of Guidance, Propaganda, Investigation and Handling of Traffic Accidents, Traffic Police Department, Ministry of Public Security, said that the driving license system stipulated in the 2008 Road Traffic Law has many points that are incompatible with the classification of the 1968 Vienna Convention and many countries.

Specifically, many of Vietnam's motorcycle and car license classifications are not suitable in terms of cylinder capacity, number of seats, and vehicle weight. Vietnam has not yet classified electric vehicles, minibuses, and small trucks. The names of license classifications are also not suitable to international standards. The Ministry of Public Security has proposed changing the driver's license classifications to be compatible with the 1968 Vienna Convention and the world.

According to the new law, motorbike and car driving licenses issued before the law takes effect can continue to be used normally according to the expiration date stated on the license. However, people are encouraged to exchange their unlimited driving licenses issued before July 1, 2012.

When a person with a driving license issued before the effective date of this law wishes to change or reissue it, the following principles will apply: A person with a class A1 license (according to the 2008 Road Traffic Law) will be transferred to class A, but will only be allowed to drive motorcycles up to 175 cm3 or electric motors up to 14 kW. Class A2 will be converted to class A; class A3 will be converted to class B1.

People with automatic B1 license can change or reissue to B class, but can only drive automatic cars; B1 and B2 class can change to B and C1 class; C class can change to the same type; D class can change or reissue to D2 class; E class can change or reissue to D class; FB2 class can change or reissue to C1E...

Deduct license points if driving in violation

The new law stipulates that each driving license has 12 points, and drivers will be deducted points for each violation. Data on the deducted points will be updated in the database system immediately after the penalty decision comes into effect and the person whose driving license points are deducted will be notified.

A driving license shall be reinstated with 12 points if all points have not been deducted and no points have been deducted within 12 months from the date of the most recent deduction. In case all points have been deducted from a driving license, the license holder shall not be allowed to drive a vehicle on the road using that type of driving license.

After at least 6 months from the date of all points being deducted, the driver's license holder must take a test on knowledge of road traffic safety and order organized by the traffic police. If the result is satisfactory, the full 12 points will be restored.

According to the Ministry of Public Security, this is a state management measure, not a form of administrative sanction. The purpose is to manage drivers throughout the process from training, testing, licensing to law enforcement. Deducting points from a driver's license also aims to improve behavior, raise awareness, and help management agencies comprehensively monitor the driver's compliance process after a violation.

To implement this, a representative of the Ministry of Public Security said the Government will issue specific regulations on the authority, basis, order, and procedures for deducting points and restoring driving licenses; and on serious violations that pose a high risk of causing traffic insecurity.

Drivers who have not paid fines will not be granted a new driver's license.

The Law on Road Traffic Order and Safety also stipulates that drivers who have not complied with administrative sanctions for road traffic violations will not be granted, changed, or issued a driver's license.

A person with a driving license can have it changed or reissued in the following cases: The license is lost; damaged and no longer usable; within the time limit stated on the driving license; changes in information stated on the license; a foreign driving license issued by a competent foreign authority that is still valid; a driving license issued by the Ministry of National Defense or the Ministry of Public Security upon request or the person granted it is no longer performing defense or security duties.

The driving license will be revoked in the following cases: The licensee does not meet the health requirements according to the conclusion of the medical examination and treatment facility for each license category; the license is issued in violation of regulations; the license has exceeded the temporary detention period or the statute of limitations for the execution of the decision to handle administrative violations according to the provisions of the law on handling administrative violations. Violators who do not come to receive the license without a valid reason will also have it revoked.

The transport sector is managing 55.6 million driving licenses, both for cars and motorbikes. Of these, about 22 million paper-based, indefinite-term motorcycle licenses (types A1, A2 and A3) issued from 1995 to July 2012 need to be converted to plastic cards (PET) to be integrated into the VNeID system.
