The Government has just issued Decree No. 124/2024/ND-CP amending and supplementing a number of articles of Decree No. 86/2018/ND-CP with many new points on regulations on foreign investment cooperation in the field of education in Vietnam.
Notably, Decree No. 124 adds specific regulations on the establishment of branches of foreign higher education institutions in Vietnam, contributing to selectively attracting investment from quality higher education institutions.
Specifically, foreign higher education institutions investing in establishing branches in Vietnam must be established and operate legally abroad, and be among the top 500 higher education institutions ranked highest in the world's prestigious university rankings for one of the three most recent years.
Branches of foreign higher education institutions in Vietnam are allowed to operate according to the training and accreditation standards of the foreign higher education institution that established the branch (however, the conditions regarding facilities and lecturer standards must not be lower than those prescribed for Vietnamese educational institutions).
Decree No. 124 also added regulations on the quality of foreign preschool and general education programs taught in Vietnam.
Specifically, foreign preschool and general education programs, if implemented in Vietnam, must be recognized or quality-assessed by competent foreign educational agencies or organizations, must be taught directly for at least 5 years abroad, and must ensure educational goals are consistent with Vietnam's educational goals.
Preschool and general education institutions teaching foreign educational programs must seek the opinion of local state education management agencies to manage the content and quality of foreign educational programs when implemented in Vietnam.
For preschools and general education institutions that are currently teaching foreign education programs to Vietnamese students, they do not have to re-register for educational activities, but must supplement and complete their records and report to the local Department of Education and Training on the implementation of foreign education programs within 6 months from the effective date of Decree 124.
Simplify procedures
Decree No. 124/2024/ND-CP has amended and simplified 14/21 forms in Decree No. 86/2018/ND-CP, supplemented regulations on online submission and reporting, regulations on exploitation and sharing of common data between state management agencies to facilitate and reduce costs for individuals and organizations when performing administrative procedures, contributing to the implementation of the Government's guiding viewpoint of creating all favorable conditions for businesses and people to participate in business activities.
At the same time, reduce and simplify unnecessary, unreasonable and illegal regulations that are barriers and cause difficulties for business activities of enterprises and people.
Ensure publicity and transparency, strongly improve the investment and business environment, and enhance national competitiveness.
